Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning
Act 1990.
That the parking provision shall be as shown on the deposited drawing, reference 489/6 all constructed, surfaced and laid out, retained and maintained to the satisfaction of the Local Planning Authority.
Reason: To comply with the Local Planning Authority's vehicle parking
standards and to protect local amenities in accordance with
Policy G11 of the adopted South Oxfordshire Local Plan.
That the buildings shall not be occupied until the means of access between the land and the highway has been formed, laid out and constructed strictly in accordance with the deposited drawing 489/6 and all ancillary works thereon specified have been undertaken strictly in accordance with the said deposited plan.
Reason: In the interests of highway safety and convenience in accordance with
Policy G10 of the adopted South Oxfordshire Local Plan.
That the buildings shall not be occupied until the existing eastern access has been closed by the erection of a new brick wall and the verge shall be reinstated.
Reason: In the interests of highway safety and convenience in accordance
with Policy G10 of the adopted South Oxfordshire Local Plan.
That the proposed rooflights shall be conservation style and shall be so retained.
Reason: To safeguard the character of the listed buildings in accordance with
Policy CON7 of the adopted South Oxfordshire Local Plan.
That development shall not begin until a detailed specification of the type, design and external finish of all windows, external doors and rainwater goods has been submitted to and approved in writing by the Local Planning Authority.
Reason: To ensure that the details of the development are satisfactory in
accordance with Policy CON7 of the adopted South Oxfordshire
Local Plan.
That no development shall take place until there has been submitted to and approved in writing by the Local Planning Authority a scheme of landscaping which shall include indications of all existing trees and hedgerows on the land, and details of any to be retained, together with measures for their protection in the course of development. The retained trees shall be protected whilst development operations are in progress in accordance with advice given in
BS 5837 "Trees in relation to construction".
Reason: To protect local amenities in accordance with Policy C16 of the
adopted South Oxfordshire Local Plan.
That all planting, seeding or turfing comprised in the approved scheme of landscaping shall be carried out in the first planting and seeding seasons following the occupation of the buildings or the completion of the development, whichever is the sooner; and any trees or plants which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation.
Reason: To help to assimilate the development into its surroundings in
accordance with Policy C16 of the adopted South Oxfordshire
Local Plan.
That samples of the materials to be used for the roofs shall be submitted to and approved in writing by the Local Planning Authority before any development commences.
Reason: To ensure that the details of the development are satisfactory in
accordance with Policy G8 of the adopted South Oxfordshire
Local Plan.
That no demolition or alteration of any existing building or part of any existing building other than the demolitions and alterations shown on the approved drawings shall take place without the prior written consent of the Local Planning Authority.
Reason: To ensure a satisfactory appearance to the development and to the
conversion of these listed barns in accordance with Policy C11 of
the adopted South Oxfordshire Local Plan.
That the walls of the buildings shall be clad with timber boarding, samples and details of which shall first have been submitted to and agreed in writing by the Local Planning Authority.
Reason: To ensure a satisfactory appearance to the development and to
the conversion of these listed barns in accordance with Policy C11
of the adopted South Oxfordshire Local Plan.
That during construction no solid matter shall be stored within 10 metres of the banks of the Cuttlebrook or tributaries and thereafter no storage of materials shall be permitted in this area.
Reason: To prevent solid materials from entering the Cuttlebrook or tributaries
and causing pollution in accordance with Policy G17 of the adopted
South Oxfordshire Local Plan.
Notwithstanding the provisions of Article 3 of, and Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order), no development within Classes A, B, C, D and E of Part 1 of Schedule 2 to the Order shall be carried out on the land unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof.
Reason: To ensure that the character of the buildings and their settings are retained in accordance with Policy CON7 of the adopted South Oxfordshire Local Plan.
That prior to the first occupation of either unit 4 or unit 5, the rear gardens of those properties shall be enclosed by the erection of a brick wall, details of which shall first have been submitted to and agreed in writing by the Local Planning Authority.
Reason: To ensure that the character of the buildings and their settings are retained in accordance with Policy CON7 of the adopted South Oxfordshire Local Plan.
No development shall take place until further bat surveys have been carried out, submitted to and approved in writing by English Nature and the Local Planning Authority. Three evening survey events should be carried out one each in May, June and July and should include the following details:
(a) The extent of use of the barns by bats.
(b) Identification of the species present and population levels.
(c) Identification of any potential impact on bats.
(d) Details of mitigation measures for the protection of bats.
(e) A DEFRA license application has been submitted and approved in writing.
Reason: To help protect the habitat of animal species protected by law in accordance with Policy C14 of the adopted South Oxfordshire Local Plan.
Foul sewage shall be discharged to the foul sewer subject to the approval of Thames Water Utilities or its sewerage agent.
Reason: To prevent pollution of the water environment in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.
No development shall take place until the Local Planning Authority are satisfied that contamination has been sufficiently investigated and any remedial action approved. The site shall then not be occupied until any agreed action is implemented and approved by the Local Planning Authority.
i. The following measures (a-d) shall be undertaken to investigate and remediate any contamination on the site prior to commencement of the development:
a) A desk study shall be submitted to and approved in writing by the Local Planning Authority. This study shall be conducted fully in line with the approach indicated in BS 10175: 2001 (Investigation of potentially contaminated sites - code of practice). The study shall include the identification of all previous site uses, potential contaminants that might reasonably be expected given those uses and other relevant information. If contamination is suspected at the site the information obtained must then be used to formulate an initial conceptual model for the site including all potential contaminant sources, pathways and receptors.
b) Where contamination is identified as having the potential to be present in a) above, proposals for a site investigation to characterise the site must be submitted to and approved in writing by the Local Planning Authority. This proposal shall be designed having regard to the approved desk study and BS 10175. It should be clear about what information it seeks to obtain and how this will refine the initial conceptual model for the site.
c) The approved site investigation referred to on b) above shall be fully implemented and a report submitted to the Local Planning Authority for written approval. The report shall be in line with BS 10175 and detail the works undertaken to characterise the site and contain a refined conceptual model in the light of the results of the investigation. N.B. If the Local Planning Authority is not satisfied that the site has been adequately characterised after the first stage of investigation, further works will be required to clarify any remaining uncertainties.
d) Where unacceptable levels of contamination are identified, a remediation scheme shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall incorporate details of the procedures and documentation employed to validate the remediation measures identified in c) above.
ii. Prior to occupation of the site, the approved remediation and validation schemes in d) above shall be fully implemented and a report submitted and approved in writing by the Local Planning Authority.
Reason: To ensure that any ground and water contamination is identified and adequately addressed to ensure the safety of the development, the environment and the public and ensure that the site is suitable for the proposed use in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.
