Conditions / Refusal Reasons
That having regard to the location and form of the tennis court, the proposal would neither preserve nor enhance the Conservation Area and would detract from the established informal character of this area of river bank. Furthermore, the grading works involved in the construction of the tennis court would be detrimental to the health and longevity of the existing trees on the site which contribute significantly to the established character and appearance of the river bank. As such, the proposal would be contrary to the provisions of the Council's adopted Local Plan, particularly Policies CON8, CON10, C4 and C16, and the South Oxfordshire Local Plan 2011 Second Deposit (Draft), particularly Policies CON10, C3 and C10 and to advice in Part 3 of the South Oxfordshire Design Guide.
That the proposed tennis court would involve the raising of land liable to flood, thus increasing the risk of flooding due to impedance of flood flow routes and reduction of storage capacity. As such, the proposal would be contrary to the provisions of the Council's adopted Local Plan, particularly Policy G16, and the South Oxfordshire Local Plan 2011 Second Deposit (Draft), particularly Policy EP5.
That the proposal would lie within 10 metres of a watercourse and would thus intrude onto the river corridor and may damage the habitat of populations of the Biodiversity Action Plan Species and nationally important Loddon Lilly which exist in the local area. In the absence of appropriate survey and mitigation measures, the proposal would be contrary to the provisions of the Council's adopted Local Plan, particularly Policy C14, and the South Oxfordshire Local Plan 2011 Second Deposit (Draft), particularly Policies C8 and C10.
