Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.

That the land and buildings shall be used only for the purposes specified in the application and for no other purpose whatsoever. Reason: To protect local amenities in accordance with Policy G1 of the Adopted South Oxfordshire Local Plan.

That prior to the first use of the site for the purposes specified in the application details shall be submitted to and approved in writing by the Local Planning Authority showing zones of protection for the tree preservation order trees in accordance with BS 5837. Thereafter there shall be no vehicles, plant, machinery or materials stored or operated within the agreed zones of protection. Reason: To protect tree preservation order trees that are considered to be of significant amenity importance in accordance with Policy C17 of the Adopted South Oxfordshire Local Plan.

That vehicular movements to or from the site shall be restricted to between the hours of hours of 07:00am and 19:00pm on Mondays to Saturdays and there shall be no vehicular movements to and from the site at any time on Sundays or on Bank Holidays. Reason: To protect the residential amenities of local residents in accordance with Policies G1, G7 and E3 of the Adopted South Oxfordshire Local Plan.

That the LAeq (1 hour) from activities undertaken at the site must not exceed 30dB between 19.00pm and 7.00am and 55dB between 07.00 and 19:00pm at the boundary of the site with the nearest residential property, 2 Hermitage Cottage, Eastfield Lane. Reason: To protect the residential amenities of local residents in accordance with Policies G1, G7 and E3 of the Adopted South Oxfordshire Local Plan.

That no floodlighting or security lighting shall be installed at the site unless details have first been submitted to and approved in writing by the Local Planning Authority. All floodlighting and security lighting shall only be installed and operated in accordance with the approved details. Reason: To protect the residential amenities of local residents in accordance with Policies G1, G7 and E3 of the Adopted South Oxfordshire Local Plan.

That prior to the first use of the site as a civil engineering and public works depot compreshensive details of proposed landscaping works shall be submitted to and approved in writing by the local planning authority. The details shall include planting in the areas indicated in the plan accompanying the Agents letter dated 6th December 2004 and shall also include supplementary planting along the north west boundary of the site and screen planting on the boundary with no 2 The Hermitage. Detailed information will need to be provided on schedules of plants, species, sizes, numbers and densities. Reason: To help to assimilate the evelopment into its surroundings in accordance with Policy G9 of the Adopted South Oxfordshire Local Plan.

The approved landscape works shall be implemented in accordance with an agreed timescale that has been submitted to aned agreed in writing by the Local Planning Authority prior to the first use of the site. The timescale shall provide for all agreed planting to be carried out at the latest during the first planting season following occupation of the site for the purposed specified in the application. Except as may otherwise be agreed in writing by the local planning authority any vegetation which dies, exhibits dieback or is damaged within 5 years of implementation shall be replaced with a specimen of the same species and size. Reason: To help to assimilate the development into its surroundings in accordance with Policy G9 of the Adopted South Oxfordshire Local Plan.

That no portakabin, caravan, mobile home or other form of mobile unit which is kept on the land in pursuance of this permission shall be used for the purpose of providing residential or overnight accommodation on the land. Reason: The risidential use of such mobile units would be contrary to Policy H6 of Adopted South Oxfordshire Local Plan.

That no chippings or other road surfacing materials shall be stored on site. Reason: To protect the character and appearance of the area in accordance with Policy C2 of the Adopted South Oxfordshire Local Plan.
