Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.

That the plant and buildings hereby approved shall only be operated and used by the BOC Group Ltd, or any of its subsidiary companies in connection with the production and storage of gaseous products. Reason: In the light of the information submitted and to ensure that the details of the development are satisfactory in accordance with Policies G7 and E6 of the adopted South Oxfordshire Local Plan.

That the parking, loading, unloading and manoeuvring areas shall be formed, laid out and constructed strictly in accordance with the details on plan reference 5311.12D accompanying the application, and shall thereafter be so retained and maintained and made available for use. Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities in accordance with Policy G11 of the adopted South Oxfordshire Local Plan.

That details of the proposed colours to be used in the external finish of the building and tanks shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development. Reason: To ensure that the details of the development are satisfactory in accordance with Policy G8 of the adopted South Oxfordshire Local Plan.

That the regrading of the land shall be carried out in accordance with the details set out on plan 5311-11f accompanying the application prior to the first use of the new building or yard hereby permitted. Reason: To ensure that the details of the development are satisfactory in accordance with Policy G8 of the adopted South Oxfordshire Local Plan.

That notwithstanding the details accompanying the application, a scheme for the landscaping of the site, including the planting of live trees and shrubs and the treatment of the access road and hardstandings, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme to the complete satisfaction of the Local Planning Authority. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 3 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policies G8 and G9 of the adopted South Oxfordshire Local Plan.

That audible vehicle reversing devices should not be audible at the boundary of any residential property between 21:00 and 06.00 hours. Reason: To protect the amenity of local residents in accordance with Policies G7 and G8 of the adopted South Oxfordshire Local Plan.

That no more than 12 deliveries shall be made to and from the site in any one 24 hour period between 21:00 and 06.00 hours. Reason: To protect local amenities in accordance with Policies G7 and G8 of the adopted South Oxfordshire Local Plan.

That no development shall begin until a detailed scheme for the assessment and control of noise from the development has been submitted to and approved in writing by the Local Planning Authority in order to establish whether specific mitigation measures are required. Thereafter any mitigation measures that form part of the approved scheme shall be implemented prior to the first use of the building or yard hereby permitted and shall be permanently retained as such. Reason: To ensure that the development does not give to an unacceptable increase in noise levels to the detriment of the amenity of neighbouring residents in accordance with Policies G7 and G8 of the adopted South Oxfordshire Local Plan.

That details of surface water drainage works shall be submitted to and approved in writing by the Local Planning Authority prior to the development commencing. Reason: In the interests of public health in accordance with Policy G17 of the adopted South Oxfordshire Local Plan.

That prior to the commencement of the development full details of all lighting proposed on the site shall be submitted to and approved in writing by the Local Planning Authority. Thereafter any lighting installed shall be only as approved. Reason: To protect local amenities in accordance with Policy G8 of the adopted South Oxfordshire Local Plan.
