Demolition of bungalow and garage, erection of replacement dwelling, garage and garden wall(as amended by drawing nos.719.100B and 719.101B accompanying letter from Agent dated 8 July 2004).
Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.
That prior to the commencement of any development a sample panel of the brickwork shall be constructed on site using lime mortar. Work shall not proceed until the sample panel has written approval by the Local Planning Authority and the brickwork shall thereafter be in accordance with the approved sample panel.
Reason: In order to ensure that the brickwork of the new dwelling respects local building traditions and conserves the character and appearance of this part of the Chilterns Area of Outstanding Natural Beauty in accordance with Policies G1, C2, G8 and H16 of the adopted South Oxfordshire Local Plan.
Prior to the commencement of the development samples of all the external materials to be used in the new house, wall and garage shall be submitted to and approved in writing by the Local Planning Authority.
Reason: In order to ensure that the development is successfully assimilated in this part of the Chilterns Area of Outstanding Natural Beauty in accordance with Policies G1, G8, C2 and H16 of the adopted South Oxfordshire Local Plan.
That with the exception of the trees, shrubs and hedges shown to be removed, all trees, shrubs and hedge plants on the site shall be preserved and maintained during the course of building operations and for a period of three years following completion of the development and that in the event of any of the trees, shrubs or hedge plants dying or being seiously damaged or destroyed during that period, a new tree, shrub or hedge plant or equivalent number of trees, shrubs or hedge plants as the case may be of a species first approved by the Local Planning Authority be planted and properly maintained in a position or positions first approved by the Local Planning Authority, such planting to be implemented as approved within 12 months of the loss of the previously existing planting.
Reason: In order to ensure that the development is successfully assimilated in this part of the Chilterns Area of Outstanding Natural Beauty in accordance with Policies G1, G8, C2 and H16 of the adopted South Oxfordshire Local Plan.
That the occupation of the dwelling shall be limited to a person solely or mainly employed, or last employed, in the locality in agriculture, or in forestry, or a dependant of such a person residing with him or her, or a widow or widower of such a person.
Reason: The existing dwelling on the site was permitted as a exception to the Council's policies on the basis that it was for an agricultural worker and it is appropriate that the same restriction should be applied to the replacement dwelling in accordance with Policies G1, H6, H16, A6 and A7 of the adopted South Oxfordshire Local Plan.
That notwithstanding the provisions of Article 3 of, and Class A, C, D and E of Part 1 of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order), no development within Class A, C, D and E of Part 1 of Schedule 2 to the Order shall be carried out on the land unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof.
Reason: That this replacement dwelling is the maximum size of dwelling that is considered acceptable and in order to protect the character of the area in accordance with Policies G1, C2 and H16 of the adopted South Oxfordshire Local Plan.
That prior to completion of the development hereby permitted or the first occupation of the new dwelling whichever is the sooner, the existing bungalow shall be demolished and all the resulting materials removed from the site.
Reason: In order to ensure that the development is successfully assimilated in this part of the Chilterns Area of Outstanding Natural Beauty in accordance with Policies G1, G8, C2 and H16 of the adopted South Oxfordshire Local Plan.
