Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.

That the external walls and roofs shall be constructed and finished in accordance with a schedule of materials and finishes which shall first have been submitted to and approved in writing by the Local Planning Authority before development/works commence. Reason: To ensure that the appearance of the building(s) is satisfactory in accordance with Policy G8 of the adopted South Oxfordshire Local Plan.

That a detailed specification of the design, materials and external finishes of all windows, external doors, eaves, rainwater goods, flues and vents shall be submitted to and approved in writing by the Local Planning Authority prior to development commencing. Reason: To ensure that the appearance of the building is satisfactory in accordance with Policy G8 of the adopted South Oxfordshire Local Plan.

That prior to the commencement of the development hereby permitted the details shall be submitted to and approved in writing by the Local Planning Authority to demonstrate that the rooflights in the north west elevation of the building shall either be glazed with opaque glass or be high level. The development shall be carried out in accordance with the approved details and be retained as such thereafter. Reason: To ensure that the development is not unneighbourly in accordance with Policy H11 of the adopted South Oxfordshire Local Plan.

Prior to the commencement of any site works (including demolition or site clearance) a protected area shall be designated for all existing trees which are shown to be retained, and the trees shall be protected in accordance with a scheme which complies with BS 5837:1991 Trees in Relation to Construction and shall have been submitted to, and approved in writing by, the Local Planning Authority. The agreed measures shall be kept in place during the entire course of development Reason: To safeguard trees which are visually important in accordance with Policies G8 and C16 of the adopted South Oxfordshire Local Plan.

No development shall take place until comprehensive details of proposed landscape works have been submitted to and approved in writing by the Local Planning Authority. The details shall include any existing features or planting to be retained; planting proposals including schedules of plants, species, sizes, numbers and densities; all hard surfaces, changes of level and spot heights; means of enclosure such as walls and fencing with particulars of height, materials, brick bonds and fencing style. Reason: To help to assimilate the development into its surroundings in accordance with Policy G9 of the adopted South Oxfordshire Local Plan.

The approved landscape works shall be implemented within 12 months of the commencement of development. Except as may otherwise be agreed in writing by the local planning authority any vegetation which dies, exhibits, dieback or is damaged within 5 years of implementation shall be replaced with a specimen of the same species and size. Reason: To help to assimilate the development into its surroundings in accordance with Policy G9 of the adopted South Oxfordshire Local Plan.

That prior to the commencement of the development details of secure cycle parking shall be submitted to and agreed in writing by the Local Planning Authority and the cycle parking shall be provided prior to the first use of the building. Reason: To help reduce dependence on car travel to and from the site in accordance with Policies G2 and G11 of the adopted South Oxfordshire Local Plan.

Surface water source control measures shall be carried out in accordance with details which shall have been submitted to and approved in writing by the Local Planning Authority before development commences. Reason: To prevent the increased risk of flooding and to improve water quality in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.

No development shall take place until the Local Planning Authority are satisfied that contamination has been sufficiently investigated and any remedial action approved following measures (a-d) below. The site shall then not be occupied until any agreed action is implemented and approved by the Local Planning Authority. a) A desk study shall be submitted to and approved in writing by the Local Planning Authority. This study shall be conducted fully in line with BS 10175:2001 (Investigation of potentially contaminated sites - code of practice) and identify all previous site uses and the contaminants that might reasonably be expected and any other relevant information. The information must then be used to formulate an initial conceptual site model including all potential contaminant sources, pathways and receptors. b) Where contamination is identified as having the potential to be present in a) above, proposals for a site investigation to characterise the site must be submitted to and approved in writing by the Local Planning Authority before any investigations are carried out. This proposal shall be designed having regard to the approved desk study and BS 10175. It should be clear about what information the investigation seeks to obtain and how this will refine the initial conceptual model for the site. The investigation must be comprehensive enough to enable a risk assessment relating to ground water, surface waters, current and future residents and any other relevant receptors associated on and off site that may be affected. It must also be sufficient enough to enable production of any necessary Method Statements detailing the remediation requirements. c) The approved site investigation in b) above shall be fully implemented and a report submitted to the Local Planning Authority for written approval. The report shall be in line with BS 10175 and detail the works undertaken to characterise the site and contain a refined conceptual model in the light of the results of the investigation . N.B. If the Local Planning Authority is not satisfied that the site has been adequately characterised then further works will be required to clarify the remaining uncertainties. d) Where unacceptable levels of contamination are identified in c) above, a remediation scheme detailing all works, procedures and validation measures to ensure the site is suitable for its use, including measures to minimise the impact on ground waters, surface waters and any other relevant receptors shall be submitted to and approved in Writing by the Local Planning Authority. ii) Prior to occupation of the site, the approved remediation and validation schemes in d) above shall be fully implemented and a report submitted and approved in writing by the Local Planning Authority. Reason: To ensure that any ground and waer contamination is identified and adequately addressed to ensure the safety of the development, the environment and the public and ensure that the site is suitable for the proposed use.

No soakaways shall be constructed such that they penetrate the water table, and they shall not in any event exceed 3 metres in depth below existing ground level. Reason: To prevent pollution of groundwater in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.

That development shall not commence until foul sewerage details have been submitted to and approved in writing by the Local Planning Authority. The approved details shall be implemented prior to first occupation of the building. Reason: To prevent pollution in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.

That development shall not commence until surface water drainage works have been carried out in accordance with details submitted to and approved in writing by the Local Planning Authority Reason: To prevent pollution and flooding in accordance with Policies G6 and G17 of the adopted South Oxfordshire Local Plan.

That prior to the commencement of any other development to which this permission relates, the means of access between the land and the highway shall be formed, laid out and constructed strictly in accordance with the specification of the means of access attached hereto, and all ancillary works therein specified shall be undertaken strictly in accordance with the said specification. Reason: In the interests of highway safety and convenience in accordance with Policy G10 of the adopted South Oxfordshire Local Plan.

That the building shall not be occupied until the parking provision has been constructed, surfaced and laid out, as shown on drawing no. 03 WDC 10 B; and such parking provision shall be retained thereafter. Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities in accordance with Policies G8 and G11 of the adopted South Oxfordshire Local Plan.

That no surface water shall be discharged onto the public highway. Reason: In the interests of highway safety and convenience in accordance with Policy G10 of the adopted South Oxfordshire Local Plan.

That prior to the commencement of the development details shall be submitted to and agreed in writing by the Local Planning Authority to demonstrate that the vegetation along the site frontage will be cut back. The work shall be carried out in accordance with the approved details prior to the first occupation of the building and shall be retained as such thereafter. Reason: In the interests of highway safety and convenience in accordance with Policy G10 of the adopted South Oxfordshire Local Plan.

That a new fence shall be constructed at a height of 1.8 metres along the south west boundary of the land in accordance with details which shall first have been submitted to and approved in writing by the local planning authority, and the fence as approved shall be erected prior to the first occupation of any part of the development hereby approved and thereafter retained without alteration, unless written consent to any variation is given by the Local Planning Authority. Reason: To help to ensure that the development is not unneighbourly or intrusive in accordance with Policy G1 of the adopted South Oxfordshire Local Plan.

That prior to the commencement of the development details of any external lighting shall be submitted to and approved in writing by the Local Planning Authority. Reason: To protect the character and appearance of the area in accordance with Policy C2 of the adopted South Oxfordshire Local Plan.

That the open areas of the site as shown on Drawing * shall be used for parking of vehicles, loading, unloading, manoeuvring and amenity/landscaping purposes only and no storage, industrial or other business use shall take place other than inside the building. Reason: To protect local amenities in accordance with Policy G1 of the adopted South Oxfordshire Local Plan.

That the use of the building shall be limited to the use defined in Class B1 of the Schedule of the Town and Country Planning (Use Classes) Order 1987. Reason: To safeguard the character of the area in accordance with Policy G1 of the adopted South Oxfordshire Local Plan.
