Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.

That the external walls and roofs shall be constructed and finished in accordance with a schedule of materials and finishes which shall first have been submitted to and approved in writing by the Local Planning Authority before development commences. Reason: To ensure that the appearance of the buildings are satisfactory in accordance with Policy G8 of the adopted South Oxfordshire Local Plan.

That prior to the first occupation of any of the development hereby permitted the first floor bathroom windows in elevations A and D shall be glazed with opaque glass and the glazing incorporated in the windows shall thereafter be retained and maintained as such. Reason: To ensure that the development is not unneighbourly in accordance with Policy H11 of the adopted South Oxfordshire Local Plan.

That notwithstanding the details shown on drawing 990403 A the first floor kitchen windows in elevations A and D shall be constructed to have a minimum cill height of 1.7 metres above finished floor level and shall be retained as such thereafter. Reason: To ensure that the development is not unneighbourly in accordance with Policy H11 of the adopted South Oxfordshire Local Plan.

That the apartments shall not be occupied until the means of access between the land and the highway has been formed, laid out and constructed strictly in accordance with the specification of the means of access attached hereto, and all ancillary works therein specified have been undertaken strictly in accordance with the said specification. Reason: In the interests of highway safety and convenience in accordance with Policy G10 of the adopted South Oxfordshire Local Plan.

That the apartments shall not be occupied until the existing accesses to the highway are permanently and effectively closed and the footpath re-instated in accordance with a scheme to be submitted to and approved by the Local Planning Authority. Reason: In the interests of highway safety and convenience in accordance with Policy G10 of the adopted South Oxfordshire Local Plan.

That the apartments shall not be occupied until the parking provision has been constructed, surfaced and laid out, as shown on drawing no. 990403 A ; and such parking provision shall be retained thereafter. Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities in accordance with Policies G8 and G11 of the adopted South Oxfordshire Local Plan.

That the apartments shall not be occupied until the lockable cycle store has been provided as shown on drawing no. 990403 A ; and such cycle storage provision shall be retained thereafter. Reason: To comply with the Local Planning Authority's standards and to protect local amenities in accordance with Policies G8 and G11 of the adopted South Oxfordshire Local Plan.

Prior to the commencement of any site works (including demolition or site clearance) a protected area shall be designated for the Monkey Puzzle tree, and the tree shall be protected in accordance with a scheme which complies with BS 5837:1991 Trees in Relation to Construction and shall have been submitted to, and approved in writing by, the local planning authority. The agreed measures shall be kept in place during the entire course of development Reason: To safeguard trees which are visually important in accordance with Policies G8 and C16 of the adopted South Oxfordshire Local Plan.

No development shall take place until comprehensive details of proposed landscape works have been submitted to and approved in writing by the local planning authority. The details shall include specific provision for the planting of a hedge along the front boundary of the site and details of any existing features or planting to be retained; planting proposals including schedules of plants, species, sizes, numbers and densities; all hard surfaces, changes of level, means of enclosure such as walls and fencing with particulars of height, materials, brick bonds and fencing style. Reason: To help to assimilate the development into its surroundings in accordance with Policy G9 of the adopted South Oxfordshire Local Plan.

The approved landscape works shall be implemented within 12 months of the commencement of development. Except as may otherwise be agreed in writing by the local planning authority any vegetation which dies, exhibits, dieback or is damaged within 5 years of implementation shall be replaced with a specimen of the same species and size. Reason: To help to assimilate the development into its surroundings in accordance with Policy G9 of the adopted South Oxfordshire Local Plan.

That notwithstanding the details shown on drawing no 990403 A details of alternative bin storage shall be submitted to and be approved in writing by the Local Planning Authority. The bin storage facility shall be provided prior to the first occupation of any of the apartments and shall be retained thereafter. Reason: In the interests of public health and to comply with Policies G7 and H11 of the Council's Adopted South Oxfordshire Local Plan.
