Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.

That a detailed specification of the design, materials and external finishes of all windows, external doors, eaves, rainwater goods, flues and vents shall be submitted to and approved in writing by the Local Planning Authority prior to development commencing. Reason: To ensure that the appearance of the buildings is satisfactory in accordance with Policy G8 of the adopted South Oxfordshire Local Plan.

That the external walls and roofs shall be constructed and finished in accordance with a schedule of materials and finishes which shall first have been submitted to and approved in writing by the Local Planning Authority before development/works commence. Reason: To ensure that the appearance of the buildings is satisfactory in accordance with Policy G8 of the adopted South Oxfordshire Local Plan.

That all existing buildings on the site shall be demolished before the new development hereby permitted commences, and any demolished material which is not to be utilised in the new development shall be removed from the land, unless an alternative scheme for the phased demolition of the building(s) and removal of materials shall first have been submitted to and approved in writing by the Local Planning Authority. Reason: To ensure satisfactory comprehensive development in accordance with Policy G1 of the adopted South Oxfordshire Local Plan.

That prior to the commencement of the development details of the slab levels of the houses shall be submitted to and approved in writing by the Local Planning Authority and the development shall only be carried out in accordance with the approved details. Reason: To ensure satisfactory comprehensive development and to prevent increased risk of flooding in accordance with Policy G1 and G16 of the adopted South Oxfordshire Local Plan.

The design and construction of the building shall incorporate the flood resistant construction measures outlined in the submitted Flood Risk Assessment (dated 11 September 2003 carried out by Monson Engineering) and drawing no. 02...22...3. Reason: To protect the building and its occupants from the risk of flooding in accordance with Policy G16 of the adopted South Oxfordshire Local Plan.

That no building or raising of land levels shall take place within the site. Reason: To prevent increased risk of flooding due to impedance of flood flows and reduction of flood storage capacity in accordance with Policy G16 of the adopted South Oxfordshire Local Plan.

That no spoil or materials shall be deposited or stored on that part of the site lying within the area liable to flood. Reason: To prevent increased risk of flooding due to impedance of flood flows and reduction of flood storage capacity in accordance with Policy G16 of the adopted South Oxfordshire Local Plan.

That any walls or fences to be constructed within or around the site shall be designed to be permeable to flood water. Reason: To prevent obstructed to the flow and storage of flood water in accordance with Policy G16 of the adopted South Oxfordshire Local Plan.

The garage shall be constructed with the floor slab at existing ground level, with apertures in the side and rear walls from ground level up to the flood water level (36.02 m AOD) and with gaps left under the main garage doors. Any spoil arising from the excavation shall be removed from the floodplain. Reason: To prevent the increased risk of flooding due to impedance of flood flows and reduction of flood water storage capacity and to allow free entry and egress of flood water in accordance with Policy G16 of the adopted South Oxfordshire Local Plan.

Openings and any associated grills to the under-floor voids shall be constructed in accordance with details to be submitted to and approved by the Local Planning Authority before development commences. Reason: To ensure that free passage of flood water through the under-floor voids of the building is provided for in accordance with Policy G16 of the adopted South Oxfordshire Local Plan.

The construction of the foul and surface water drainage system shall be carried out in accordance with details submitted to and approved in writing by the Planning Authority before the development commences. Reason: To prevent pollution of the water environment and the increased risk of flooding in accordance with Policy G16 and G7 of the adopted South Oxfordshire Local Plan.

No development shall take place until comprehensive details of proposed landscape works have been submitted to and approved in writing by the local planning authority. The details shall include any existing features or planting to be retained; planting proposals including schedules of plants, species, sizes, numbers and densities; all hard surfaces, changes of level and spot heights; means of enclosure such as walls and fencing with particulars of height, materials, brick bonds and fencing style. Reason: To help to assimilate the development into its surroundings in accordance with Policy G9 of the adopted South Oxfordshire Local Plan.

The approved landscape works shall be implemented within 12 months of the commencement of development. Except as may otherwise be agreed in writing by the local planning authority any vegetation which dies, exhibits, dieback or is damaged within 5 years of implementation shall be replaced with a specimen of the same species and size. Reason: To help to assimilate the development into its surroundings in accordance with Policy G9 of the adopted South Oxfordshire Local Plan.

That the dwellings shall not be occupied until the means of access between the land and the highway has been formed, laid out and constructed strictly in accordance with the deposited plan reference 02.22.3 and all ancillary works thereon specified have been undertaken strictly in accordance with the said deposited plan. Reason: In the interests of highway safety and convenience in accordance with Policy G10 of the adopted South Oxfordshire Local Plan.

That no dwelling shall be occupied until space has been laid out within each curtilage for 2 cars to be parked and for vehicles to turn so that they may enter and leave the site in forward gear. Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities in accordance with Policies G8 and G11 of the adopted South Oxfordshire Local Plan.

That notwithstanding the provisions of Article 3 of, and Classes A, B, D, E and F of Part 1 of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order), no development within Classes A, B, D, E and F of Part 1 of Schedule 2 to the Order shall be carried out on the land unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof. Reason: To protect the character and appearance of the area and to prevent obstruction to the storage and flow of flood water in accordance with policies G1 and G16 of the Council's Adopted South Oxfordshire Local Plan
