Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.

The samples of the tiles to be used for the roof shall be submitted to and approved in writing by the Local Planning Authority before any development commences. Reason: To safeguard the character and appearance of the Brightwell-cum-Sotwell Conservation Area in accordance with Policy Con 10 of the adopted South Oxfordshire Local Plan.

That notwithstanding the provisions of Article 3 of, and Class A of Part 1 of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order), no windows shall be inserted in the rear elevation unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof. Reason: To ensure that the development is not unneighbourly in accordance with Policy G8 of the adopted South Oxfordshire Local Plan.

That a scheme for the landscaping of the site, including the planting of live trees and shrubs, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme to the complete satisfaction of the Local Planning Authority. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 3 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policy G9 of the adopted South Oxfordshire Local Plan.

That the existing yew trees and horse chestnut tree as shown on the submitted site plan shall be protected by fencing in accordance with British Standards 5837:1991 Trees in Relation to Construction and in accordance with a scheme to be first agreed in writing by the Local Planning Authority and to be implemented prior to the demolition of the existing garage and the commencement of the development. Reason: To safeguard trees and hedges which are visually important in accordance with Policy G8 of the adopted South Oxfordshire Local Plan.
