Conditions / Refusal Reasons
That having regard to the height, the design and the location of the acoustic fencing within the grounds of this grade II* listed building and, in part, on a prominent road side through a rural village, the proposal represents an unacceptable form of development that would detract from the setting of the listed building and the rural character and visual amenity of this part of the Chilterns Area of Outstanding Natural Beauty. As such the proposal would be contrary to Policies G1, C1, C2, C6 and CON7 of the adopted South Oxfordshire Local Plan and Policies G2, C1, C2, C4 and CON7 of the South Oxfordshire Local Plan 2011 First Deposit (Draft).
That having regard to the height, design and form of the acoustic fencing and its position in relation to the neighbouring property, Carters Cottage, the proposal represents an oppressive and overbearing form of development that would detract from the residential amenity of the occupants of Carters Cottage. As such the proposal would be contrary to Policy G1 of the adopted South Oxfordshire Local Plan and Policy G2 of the South Oxfordshire Local Plan 2011 First Deposit (Draft).
That having regard to the position of the proposed acoustic fencing in relation to mature trees on the roadside boundary and to the depth of foundations required for a fence of this specification, the proposal would have a detrimental impact on tree roots in the vicinity and would threaten the long term health of the affected trees. As such the proposal would be contrary to Policies G1 and C16 of the adopted South Oxfordshire local Plan and Policies G2 and C10 of the South Oxfordshire Local Plan 2011 First Deposit (Draft).
