Description
Erection of garage including MOT facility, showroom, used car display, workshop, car wash and parking(as amended by drawing nos. Arc 10 and 11 accompanying letter from Agent dated 1 March 2004 and Landscape Design dated 14 February 2004. Also amended by letter from the Agent dated 16 March 2004).
Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning
Act 1990.
That except insofar as may be otherwise agreed by the Local Planning Authority, all trees, shrubs and hedges on the land be preserved and properly maintained and that in the event of any of the trees dying or being seriously damaged or destroyed, a new tree or equivalent number of trees, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in
accordance with Policies G1 and C3 of the adopted South
Oxfordshire Local Plan.
That notwithstanding the details submitted with the application, details of the layout of the used car display and the type and extent of new planting along the boundary of the site with the A329 shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development.
Reason: To help to assimilate the development into its surroundings in
accordance with Policies G1, C3 and G9 of the adopted South
Oxfordshire Local Plan.
That notwithstanding the details submitted with the application, details of the siting of the car wash to the rear of the site shall be submitted to and approved by the Local Planning Authority prior to the commencement of the development.
Reason: To safeguard trees and hedges which are visually important in
accordance with Policies G1, G8 and C3 of the adopted South
Oxfordshire Local Plan.
That notwithstanding the details of the lighting submitted with the application, the lights shall be of the flat glass type mounted horizontally in accordance with details to be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development.
Reason: To safeguard the character of the area in accordance with Policies G1,
G8 and C3 of the adopted South Oxfordshire Local Plan.
That no occupation of the building shall take place until the new planting within the established hedge outside the application site area has been completed in accordance with the details submitted on drawing 306.2.
Reason: To help to assimilate the development into its surroundings in
accordance with Policy G9 of the adopted South Oxfordshire Local
Plan.
That all planting, seeding or turfing comprised in the approved scheme of landscaping shall be carried out in the first planting and seeding seasons following the occupation of the buildings or the completion of the development, whichever is the sooner; and any trees or plants which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation.
Reason: To help to assimilate the development into its surroundings in
accordance with Policies G1 and C3 of the adopted South Oxfordshire
Local Plan.
That the parking provision shall be as shown on the deposited drawing, reference 0943/Arch10 all constructed, surfaced and laid out, retained and maintained to the satisfaction of the Local Planning Authority.
Reason: To comply with the Local Planning Authority's vehicle parking
standards and to protect local amenities in accordance with
Policy G11 of the adopted South Oxfordshire Local Plan.
That no petrol sales shall take place from the site.
Reason: To secure the proper planning of the locality in accordance with
Policy G1 of the adopted South Oxfordshire Local Plan.
