Description
Erection of 4 no. new dwellings with associated parking, new vehicular access and closure of existing access. (As amended by drawings and letter received from the Agent dated 6th January 2004 and by Drawing Nos. L1103/03D & L1103/04B and additional Drawing No. L1103/08 accompanying Agent's letter dated 22 January 2004).
Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning
Act 1990.
That no development shall be carried out on the site unless an application for planning permission in that behalf is first submitted to and approved by the Local Planning Authority, and this condition shall apply notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995.
Reason: To secure the proper planning of the locality in accordance with
Policies G8, CON10 and H11 of the adopted South Oxfordshire
Local Plan.
That samples of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority before the development is commenced.
Reason: To ensure that the details of the development are satisfactory in
accordance with Policies G8 and CON10 of the adopted South
Oxfordshire Local Plan.
That development shall not begin until a detailed specification of the type, design and external finish of all windows, external doors and rainwater goods has been submitted to and approved in writing by the Local Planning Authority.
Reason: To ensure that the details of the development are satisfactory in
accordance with Policies G8 and CON10 of the adopted South
Oxfordshire Local Plan.
That notwithstanding the details submitted as part of the application, window details shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of any development on the site.
Reason: To ensure that the details of the development are satisfactory in
accordance with Policy CON10 of the adopted South Oxfordshire
Local Plan.
That except insofar as may be otherwise agreed by the Local Planning Authority, all trees, shrubs and hedge plants on the land be preserved and properly maintained during the course of building operations and for a period of three years following completion of the development and that in the event of any of the trees, shrubs or hedge plants dying or being seiously damaged or destroyed during that period, a new tree, shrub or hedge plant or equivalent number of trees, shrubs or hedge plants as the case may be of a species first approved by the Local Planning Authority be planted and properly maintained in a position or positions first approved by the Local Planning Authority, such planting to be implemented as approved within 12 months of the loss of the previously existing planting.
Reason: To safeguard the character of the area in accordance with Policy G8
of the adopted South Oxfordshire Local Plan.
That surface water shall not be disposed of other than in accordance with a detailed surface water drainage scheme which shall first have been submitted to and approved in writing by the Local Planning Authority.
Reason: In the interests of public health in accordance with Policy G6 of the
adopted South Oxfordshire Local Plan.
That prior to the commencement of any other development to which this permission relates, the means of access between the land and the highway shall be formed, laid out and constructed strictly in accordance with the specification of the means of access attached hereto, and all ancillary works therein specified shall be undertaken strictly in accordance with the said specification.
Reason: In the interests of highway safety and convenience in accordance
with Policy CON10 of the adopted South Oxfordshire Local Plan.
That the parking provision shall be as shown on the deposited drawing, reference L1103/03/D all constructed, surfaced and laid out, retained and maintained to the satisfaction of the Local Planning Authority.
Reason: To comply with the Local Planning Authority's vehicle parking
standards and to protect local amenities in accordance with
Policy G11 of the adopted South Oxfordshire Local Plan.
That prior to the occupation of the dwellings hereby approved the existing access shall be closed and the highway kerbline and footway reinstated.
Reason: In the interests of highway safety and convenience in accordance
with Policy G10 of the adopted South Oxfordshire Local Plan.
That no surface water shall discharge to the public highway.
Reason: In the interests of highway safety and convenience in accordance
with Policy G10 of the adopted South Oxfordshire Local Plan.
That a scheme for the landscaping of the site, including the planting of live trees and shrubs, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme to the complete satisfaction of the Local Planning Authority. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 3 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in
accordance with Policy G9 of the adopted South Oxfordshire Local
Plan.
That prior to the commencement of any development on the site, details of the treatment of the hard surfaced areas shall be submitted to and approved in writing by the Local Planning Authority.
Reason: To ensure that the details of the development are satisfactory in
accordance with Policy G8 of the adopted South Oxfordshire Local
Plan.
