Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning
Act 1990.
That the detailed design of and samples of the materials to be used for the first floor balcony screen shall be submitted to and approved in writing by the Local Planning Authority before any development commences.
Reason: To ensure that the details of the development are satisfactory and to
be in accordance with policies H5 and H12 of the South Oxfordshire
Local Plan.
That the first floor balcony screen shall be provided in accordance with condition 2 of this planning permission prior to the first occupation of the new dwelling and shall thereafter be retained as such unless otherwise agreed in writing by the Local Planning Authority.
Reason: To safeguard the privacy of adjacent properties and to be in
accordance with policy H5 of the South Oxfordshire Local Plan.
That samples of all external materials to be used in the development shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development.
Reason: To ensure the details of the development are satisfactory in
accordance with policies C3 and G8 of the South Oxfordshire
Local Plan.
That notwithstanding anything contained in the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order) no additional windows shall be constructed in the northern elevation facing Brightwater without the express planning permission of the Local Planning Authority.
Reason: In order to safeguard to the amenities of the neighbouring property in
accordance with policy H5 of the South Oxfordshire Local Plan.
That no development which falls under Class A and B of the Town and Country Planning (General Permitted Development) Order 1995 or any statutory modification or re-enactment thereof, shall be carried out on the site unless an application for planning permission is first submitted to, and approved by, the Local Planning Authority.
Reason: In order to preserve the visual amenties of the locality and the amenity
of neighbours in accordance with policies H5 and C3 of the South
Oxfordshire Local Plan.
There shall be no raising of existing external ground levels on the site.
Reason: In order to prevent the increased risk of flooding due to impedance of
flood flow and reduction of flood storage capacity in accordance
with policy G16 of the South Oxfordshire Local Plan.
No spoil or materials shall be deposited or stored on that part of the site lying within the area of land liable to flood.
Reason: In order to prevent the increased risk of flooding due to impedance of
flood flow and reduction of flood storage capacity in accordance
with policy G16 of the South Oxfordshire Local Plan.
The land on which the existing building is sited should be regraded to a level comparable to that of the surrounding ground levels in accordance with a scheme that shall first have been submitted to and approved in writing by the Local Planning Authority prior to the commencement of development.

flood flow and reduction of flood storage capacity in accordance
with policy G16 of the South Oxfordshire Local Plan.
