Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.

That samples of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority before the development is commenced. Reason: To ensure that the details of the development are satisfactory in accordance with Policies G1, G8 and H4 of the adopted South Oxfordshire Local Plan.

That the trees which are to be retained as part of the development shall be protected from damage before and during development in accordance with the requirements of B.S. 5837, and such details shall be submitted to and approved in writing by the Local Planning Authority before development commences. Reason: To protect trees which are visually important, particularly those protected by a Tree Preservation Order in accordance with Policies G1 and G8 of the adopted South Oxfordshire Local Plan.

That a scheme for the landscaping of the site, including the planting of live trees and shrubs, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme to the complete satisfaction of the Local Planning Authority. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 3 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policies G1, G8 and G9 of the adopted South Oxfordshire Local Plan.

That all planting, seeding or turfing comprised in the approved scheme of landscaping shall be carried out in the first planting and seeding seasons following the occupation of the buildings or the completion of the development, whichever is the sooner; and any trees or plants which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation. Reason: To help to assimilate the development into its surroundings in accordance with Policies G1, G8 and G9 of the adopted South Oxfordshire Local Plan.

That details of surface water drainage works shall be submitted to and approved in writing by the Local Planning Authority prior to the development commencing. Reason: In the interests of public health in accordance with Policy G17 of the adopted South Oxfordshire Local Plan.

That the parking provision shall be as shown on the deposited drawing, reference 0355-P01 all constructed, surfaced and laid out, retained and maintained to the satisfaction of the Local Planning Authority. Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities in accordance with Policy G11 of the adopted South Oxfordshire Local Plan.

That prior to the commencement of any other development to which this permission relates, the means of access between the land and the highway within land in applicant's ownership shall be formed, laid out and constructed strictly in accordance with the deposited plan reference 0355-P11 and the Oxfordshire County Council's specification for the construction of estate streets and all ancillary works therein specified shall be undertaken strictly in accordance with the said specification and deposited plan. Reason: In the interests of highway safety and convenience in accordance with Policy G10 of the adopted South Oxfordshire Local Plan.

That the highways works specified on drawing ref: 0355-P11(B) shall be laid out, formed and constructed prior to the occupation of the third dwelling. Reason: In the interests of highway safety and convenience in accordance with Policy G10 of the adopted South Oxfordshire Local Plan.

That prior to the commencement of the development hereby approved, details of all service runs shall be submitted to and approved in writing by the Local Planning Authority and such service runs shall be outside the exclusion zones of all retained trees as specified in B.S.5837. Reason: To safeguard trees which are visually important in accordance with Policies G1 and G8 of the adopted South Oxfordshire Local Plan.

That the specification for the access road within the applicant's ownership shall be as set out in the agent's letter dated 15 October 2003 together with the information enclosed therein. Reason: To ensure that no excavation works are undertaken that would damage the health and future well being of the trees which are protected by a Tree Preservation Order in accordance with Policies G1 and G8 of the adopted South Oxfordshire Local Plan.

That development shall not begin until a scheme for the disposal of foul sewage has been submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of public health in accordance with Policy G17 of the adopted South Oxfordshire Local Plan.

That no other development shall be carried out on the site unless an application for planning permission in that behalf is first submitted to and approved by the Local Planning Authority, and this condition shall apply notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995. Reason: To secure the proper planning of the locality in accordance with Policies G1, G8 and H4 of the adopted South Oxfordshire Local Plan.
