Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.

That samples of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority before the development is commenced. Reason: To ensure that the details of the development are satisfactory in accordance with Policy H11 of the adopted South Oxfordshire Local Plan.

That notwithstanding the details contained in the application detailed specifications of the designs, materials and external finishes of all external doors, windows (including cills and heads) eaves/fascias and rainwater goods shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development. Reason: To safeguard the character of the area in accordance with Policy G8 of the adopted South Oxfordshire Local Plan.

That a scheme for the landscaping of the site, including the planting of live trees and shrubs and hardstandings, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme to the complete satisfaction of the Local Planning Authority. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 3 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policy G1 of the adopted South Oxfordshire Local Plan.

That notwithstanding details contained in the application a detailed scheme for the treatment of all curtilage and site boundaries shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall have regard to the comments of the Crime Prevention Design Advisor set out in his letter of 5 September 2001 attached to this notice. Reason: To ensure that the details of the development are satisfactory in accordance with Policies G8 and G14 of the adopted South Oxfordshire Local Plan.

That prior to the commencement of any other development to which this permission relates, the means of access between the land and the highway shall be formed, laid out and constructed strictly in accordance with the specification of the means of access attached hereto, and all ancillary works therein specified shall be undertaken strictly in accordance with the said specification. Reason: In the interests of highway safety and convenience.

That the parking provision shall be as shown on the deposited drawing, reference 1103 7 A all constructed, surfaced and laid out, retained and maintained to the satisfaction of the Local Planning Authority. Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities.

That the existing accesses shall be permanently closed and the kerbline and footway reinstated in accordance with details to be agreed in accordance with Condition 3 above. Reason: In the interests of highway safety and convenience in accordance with Policy G11 of the adopted South Oxfordshire Local Plan.

Before any part of this development is commenced a site survey to assess the land contamination levels shall be carried out to the satisfaction of the Council and in accordance with BS10175:2001 'Investigation of potentially contaminated sites'. A remediation scheme for removing or rendering innocuous all contaminants from the site shall be submitted to and approved by the Local Planning Authority. The scheme shall include an assessment of the extent of site contamination and provide in detail the remedial measures to be taken to avoid risk to the occupiers when the site is developed. Details of the validation procedures shall also be provided. All works that form part of this remediation scheme shall be completed before any part of the development is undertaken (unless otherwise agreed in writing by the Local Planning Authority). Any imported material i.e. soil shall be tested for contamination levels therein to the satisfaction of the Council. Reason: To ensure that the occupants of the development are not subjected to any risk from land contamination in accordance with Policy H11 of the adopted South Oxfordshire Local Plan.

Before the development is commenced a detailed site investigation shall be carried out to establish if the site is contaminated, to assess the degree and nature of the contamination present, and to determine its potential for the pollution of the water environment. The method and extent of this site investigation shall be agreed with the Planning Authority prior to commencement of the work. Details of appropriate measures to prevent pollution of groundwater and surface water, including provisions for monitoring, shall then be submitted to and approved in writing by the Planning Authority before development commences. The development shall then proceed in strict accordance with the measures approved. Reason: To prevent pollution of the water environment in accordance with Policy G17 of the adopted South Oxfordshire Local Plan.

No soakaways shall be constructed in contamined land. Reason: To prevent pollution of groundwater in accordance with Policy G17 of the adopted South Oxfordshire Local Plan.

No soakaways shall be constructed such that they penetrate the water table and they shall not in any event exceed 2m in depth below existing ground level. Reason: To prevent pollution of ground water in accordance with Policy G17 of the adopted South Oxfordshire Local Plan.

That development shall not begin until a scheme for the disposal of foul sewage has been submitted to and approved in writing by the Local Planning Authority. Reason: To prevent pollution in accordance with Policy G17 of the adopted South Oxfordshire Local Plan.

That details of surface water drainage works shall be submitted to and approved in writing by the Local Planning Authority prior to the development commencing. Reason: To prevent pollution in accordance with Policy G17 of the adopted South Oxfordshire Local Plan.

That the scheme to be approved in accordance with Conditions 12 and 13 above shall include details of any diversions of exists drains. Reason: To ensure satisfactory provision services in accordance with Policy H11 of the adopted South Oxfordshire Local Plan.
