Town centre redevelopment comprising unit shops, town square, supermarket, cinema, A2, A3 uses including family bar and restaurant, health and fitness centre, offices, housing, arts, culture and entertainment centre, public conveniences, bus and taxi stand, health centre, petrol filling station, bus link and ancillary development including parking, amphitheatre, landscaping, access and service roads (as amplified by Environmental Statement deposited 11 May 2001 and as amended by letter from agent dated 22 May 2001 and accompanying plans). REQUEST FOR AMENDMENT TO APPROVED DEVELOPMENT
Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.
That before development commences, details of the phasing of the development including proposals for continued provision for car parking and means of access to the surrounding area shall be submitted to and approved by the Local Planning Authority in writing. The phasing shall include temporary arrangements for the treatment of land where demolition is not to be followed by redevelopment as part of the same phase. The development shall be carried out in accordance with the approved scheme.
Reason: To minimise the impact on the surrounding area and existing town centre services
in accordance with Policies G10 and S1 of the adopted South Oxfordshire Local
Plan.
That none of the floorspace within each phase of the development shall be occupied and used for the purposes thereby permitted until all buildings and works within that phase have been constructed and carried out.
Reason: To ensure a satisfactory environment is created within each phase in accordance
with Policies G1 and S1 of the adopted South Oxfordshire Local Plan.
That, notwithstanding details contained in the deposited elevation drawings, detailed drawings at a scale of 1:50 or 1:100 or as otherwise agreed by the Local Planning Authority shall be submitted to and approved in writing by the Local Planning Authority. The drawings shall be generally in accordance with the application drawings, supporting documents and Environmental Statement dated May 2001. The approvals shall be obtained prior to the commencement of work on any part of that phase of development with the exception of details of each shopfront and associated fascia which shall be obtained prior to installation of that shopfront.
Reason: To ensure a satisfactory standard of design and an attractive town centre
environment in accordance with Policies G1 and S1 of the adopted South
Oxfordshire Local Plan.
That detailed specifications of the following features of buildings within the development including designs, materials and external finishes shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of work on any part of that phase of development: external doors; windows; eaves/fascias/parapets; canopies; railings; vents/flues. The detailed specifications shall generally accord with details contained in the application, supporting documents and Environmental Statement dated May 2001.
Reason: To ensure a satisfactory standard of design and an attractive town centre
environment in accordance with Policies G1 and S1 of the adopted South
Oxfordshire Local Plan.
That details and samples of the materials to be used for the walls and roofs shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of any part of that phase of development.
Reason: To ensure a satisfactory standard of design and an attractive town centre
environment in accordance with Policies G1 and S1 of the adopted South
Oxfordshire Local Plan.
That details of the bond to be used for brickwork on the external walls of the dwellings in Station Road shall be submitted to and approved in writing before work on the erection of the buildings commences.
Reason: To safeguard the character and setting of the Didcot Station Road Conservation
Area in accordance with Policy Con 15 of the adopted South Oxfordshire Local
Plan.
That a detailed scheme of landscaping and external works for each phase of the development shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of any part of that phase of development. The scheme which shall generally accord with application drawing 003 and the Environmental Statement dated May 2001 shall include:
i) The location, size and species of trees and shrubs;
ii) The profiles of any banks, terraces or other earthworks;
iii) Hard surface ground materials and patterns;
iv) Walls, gates and fences;
v) Street furniture including seats, bollards and other features;
vi) Bus shelters and cycle racks/shelters;
vii) Lighting columns, luminaires and illumination details;
viii) A programme for implementation of the works.
ix) A maintenance schedule and long term management plan for the soft landscaping
works.
The scheme shall be implemented and maintained in accordance with the approved scheme. The soft landscaping scheme shall provide for the reintroduction of tree species local to the area and of plants along the watercourse which will be of value to wildlife and appropriate to a waterside location. Except as otherwise agreed in writing by the Local Planning Authority any plants which die or are damaged within 5 years shall be replaced by a specimen of the same species and size.
Reason: To ensure a satisfactory standard of design and an attractive town centre
environment, to enhance the amenity and ecological value of the site, and to
ensure a safe and secure environment in accordance with Policies G9 and C15 of
the adopted South Oxfordshire Local Plan.
That details of the siting and size of any temporary buildings required during the construction of each phase of the development shall be submitted to and approved in writing by the Local Planning Authority prior to being placed on the site.
Reason: To minimise the impact on the surrounding area and existing town centre services
in accordance with Policies G10 and S1 of the adopted South Oxfordshire Local
Plan.
That no construction work shall take place until DMH2 between Cow Lane and Broadway has been constructed and the means of access to the north of the site has been formed, laid out and constructed strictly in accordance with the deposited plan reference 011T and the Oxfordshire County Council's specification for the construction of estate streets and all ancillary works therein specified undertaken strictly in accordance with the said specification and deposited plan.
Reason: In the interests of highway safety and convenience and to protect local amenities
in accordance with Polices G7 and G10 of the adopted South Oxfordshire Local
Plan.
That provision for vehicle parking shall be made in accordance with details shown on drawing 011T. The spaces shall be constructed, surfaced, marked out as on the drawing (including reserved spaces for the disabled, shop mobility, mother and baby and motorcycles) and made available for use in accordance with the phasing scheme approved under the provisions of Condition 2. The spaces shall thereafter be retained and kept available at all times for those purposes.
Reason: In the interests of public and highway safety, to safeguard the amenities of the
locality and meet the needs for convenient access for visitors and employees in
accordance with Policy G11 of the adopted South Oxfordshire Local Plan.
That notwithstanding the provisions of Condition 11, car parking spaces for the disabled shall be constructed and maintained in the two service yards and adjacent to the health centre in accordance with details which shall have been submitted to and approved in writing by the Local Planning Authority.
Reason: To meet the needs of disabled persons in accordance with Policy G12 of the
adopted South Oxfordshire Local Plan.
That the main car park shown on drawing 011T shall be provided, managed and retained for short stay visitors and the overspill car park shall be provided, managed and maintained for short stay visitors and for up to a maximum of 25 long stay spaces. Measures to secure use of short term spaces as such shall be submitted to and approved in writing by the Local Planning Authority.
Reason: To ensure sufficient spaces are available for shoppers in accordance with
Policy T17 of the adopted South Oxfordshire Local Plan.
That provision for cycle parking shall be made in accordance with details on drawing 011T and those approved under the provisions of Conditions 2 and 8. Further provision of secure covered spaces shall be made in the principal service yard in accordance with details submitted to and approved in writing by the Local Planning Authority. The facilities shall thereafter be retained and kept available at all times.
Reason: To ensure convenient and attractive facilities are available for visitors to the site by
cycle in accordance with Policies T5 and S4 of the adopted South Oxfordshire
Local Plan.
That all means of access (on foot, by cycle and by vehicle) to and within the site shall be provided in accordance with details on drawing 011T, as approved under Condition 2 and in accordance with further details of areas to be available by different means which shall be submitted to and approved in writing by the Local Planning Authority before development commences. The details shall be generally in accordance with the application plans and supporting documents.
Reason: To maintain convenient access for all visitors and the viability and vitality of the
town centre in accordance with Policies S4, T3, G10, G11, T5 and T6 of the
adopted South Oxfordshire Local Plan.
That all buildings shall be designed to accommodate access by the disabled and the gradients of all walkways shall not exceed those specified in the application unless otherwise agreed in writing by the Local Planning Authority. Ramped fire exits from the cinema shall be provided in accordance with details submitted to and approved in writing by the Local Planning Authority.
Reason: To ensure convenient access to all public areas is available for disabled persons in
accordance with Policy G12 of the adopted South Oxfordshire Local Plan.
That except as otherwise approved in writing by the Local Planning Authority the two principal service areas and those serving the ACE building and cinema shall be used only for the loading and unloading of service vehicles, for parking and for waste storage in designated areas agreed in writing by the Local Planning Authority. No storage use shall take place except within the designated waste storage areas.
Reason: To protect local amenities and ensure that adequate space remains for parking and
servicing in accordance with Policies G1 and G11 of the adopted South
Oxfordshire Local Plan.
That deliveries to the foodstore shall only take place between the hours of 6am - 9pm (Mon - Fri); 6am - 8pm (Sat); 8am - 4pm (Sun).
Reason: To protect the amenities enjoyed by the occupiers of adjacent residential properties
from noise and disturbance in accordance with Policies G7 of the adopted South
Oxfordshire Local Plan.
That an archaeological watching brief shall be carried out during construction and groundworks within the undeveloped area of the former football ground and adjacent land and within the garage/coal yard area adjacent to Broadway in accordance with a written scheme of investigation and by a professionally competent archaeological organisation details of which shall have been submitted to and approved in writing by the Local Planning Authority.
Reason: As the site could contain features of archaeological importance in accordance with
Policy Con 18 of the adopted South Oxfordshire Local Plan.
That immediately prior to either the demolition of any structures or the felling of trees a further bat survey shall be carried out by a licensed bat worker at an appropriate time of year as determined by him in accordance with a scheme of investigation details of which shall have been submitted to and approved in writing by the Local Planning Authority. The survey and measures to mitigate the impact of the development on bats including provision of facilities for roosting and breeding shall be carried out in accordance with details including phasing approved in writing by the Local Planning Authority before the commencement of construction works.
Reason: To minimise any harm to the wildlife interest of the site in accordance with
Policy C15 of the adopted South Oxfordshire Local Plan.
That except as may be otherwise agreed in writing by the Local Planning Authority all trees within the site which are shown in the application to be retained shall be retained and those trees together with trees adjacent to the site shall be protected during development operations in accordance with a scheme submitted to and approved in writing by the Local Planning Authority. The scheme shall be implemented prior to the commencement of development on land adjacent to those trees.
Reason: To safeguard trees which contribute to the amenity of the area in accordance with
Policy C16 of the adopted South Oxfordshire Local Plan.
That notwithstanding the provisions of the Town and Country Planning (Use Classes) Order 1987 and the Town and Country Planning (General Permitted Development) Order 1995 or any Orders revoking and re-enacting those Orders, the cafe bar and public house adjacent to the proposed town square shall only be used for purposes within Class A3 of the Schedule to the (Use Classes) Order which are open to the public for at least throughout the period of 10.00 am to 5.30pm Monday to Saturday inclusive or within Class A1 of that Schedule.
Reason: These units are in locations where an active daytime use is important to the vitality
of the town square and the viability of the town centre in accordance with
Policies S2 and S5 of the adopted South Oxfordshire Local Plan.
That the rating level of all plant or machinery shall not exceed 35dB in accordance with B.S.4142.
Reason: To provide and maintain satisfactory standards or residential amenity for the
occupiers of proposed and existing adjacent properties in accordance with
Policies G7 and H11 of the adopted South Oxfordshire Local Plan.
That the average LAeq 1 hour facade noise measurement at those sites identified in Appendix F1 of the submitted Environmental Statement and at the facades of proposed flats shall not represent any increase in background levels as indicated in paragraph 6.50, page 60, Part 3 of that Statement. With regard to the proposed flats, the background levels shall be those stated for 1 White Leys Close.
Reason: To provide and maintain satisfactory standards or residential amenity for the
occupiers of proposed and existing adjacent properties in accordance with
Policies G7 and H11 of the adopted South Oxfordshire Local Plan.
Before the development is commenced a detailed scheme for the investigation of any contaminated soil or materials, the assessment of the degree and nature of such contamination, its potential for the pollution of the water environment. The method and extent of this site investigation shall be agreed with the Planning Authority prior to commencement of the work. Details of appropriate measures to remediate the contamination and to prevent pollution of groundwater and surface water, including provision for monitoring, shall then be submitted to and approved in writing by the Planning Authority before development commences. The development shall then proceed in strict accordance with the measures approved.
Reason: To prevent pollution of the environment in accordance with Policy G7 of the
adopted South Oxfordshire Local Plan.
The development shall not commence until a scheme for surface water drainage has been submitted to and approved in writing by the Local Planning Authority. The scheme shall be generally in accordance with details contained in the application plans, supporting documents and Environmental Statement dated May 2001.
Reason: To prevent the increased risk of flooding in accordance with Policy G7 of the
adopted South Oxfordshire Local Plan.
Surface water source control measures shall be carried out in accordance with details which shall have been submitted to and approved in writing by the Local Planning Authority before development commences. The details shall be generally in accordance with the application plans and supporting documents and Environmental Statement dated May 2001.
Reason: To prevent the increased risk of flooding and to improve water quality in
accordance with Policy G16 of the adopted South Oxfordshire Local Plan.
That development shall not begin until a scheme for the disposal of foul sewage has been submitted to and approved in writing by the Local Planning Authority The scheme shall be generally in accordance with details contained in the application plans, supporting documents and Environmental Statement dated May 2001.
Reason: To prevent pollution of the environment in accordance with Policy G7 of the
adopted South Oxfordshire Local Plan.
That details submitted in accordance with Conditions 4-6 shall be accompanied by the results and recommendations of an energy audit as referred to in the statement accompanying the application.
Reason: To ensure a sustainable form of development in accordance with Policy G2 of the
adopted South Oxfordshire Local Plan and the South Oxfordshire Design Guide.
That a Green Travel Plan shall be implemented and maintained in accordance with details submitted to and approved in writing by the Local Planning Authority prior to first occupation of any new building hereby permitted. The details shall be generally in accordance with the Green Travel Plan contained in the submitted Transportation Assessment.
Reason: To ensure a sustainable form of development in accordance with Policies G2, T3,
T5 and T6 of the adopted South Oxfordshire Local Plan and the South Oxfordshire
Design Guide.
That no dwelling shall be erected until measures to secure on the site or in the vicinity a minimum of 6 affordable dwellings as defined within Policy H7 and paragraphs 6.29 - 6.31 of the adopted South Oxfordshire Local Plan have been submitted to and approved in writing by the Local Planning Authority.
Reason: To ensure adequate provision of affordable housing in accordance with Policy H7
of the adopted South Oxfordshire Local Plan.
