Conditions / Refusal Reasons
That the development be carried out strictly in accordance with the particulars of the development contained in the application to seek permission for the development and the plan numbers SK01, TP01, TP02, TP03, TP04, TP05, TP06, TP07 and TP08 accompanying such application except as modified by conditions of this permission unless otherwise agreed by the Chief Planning Officer in writing. Reason: To ensure the details of the development are carried out in accordance with the application as approved.

That development must be begun not later than the expiration of five years beginning with the date hereof. Reason: By virtue of the provisions of Section 91(1)(a) of the Town and Country Planning Act, 1990.

That the land be landscaped and planted with trees and shrubs in accordance with a comprehensive planting and landscaping scheme first approved by the Chief Planning Officer and that trees and shrubs so planted be properly maintained and that in the event of any of the trees or shrubs dying or being seriously damaged or destroyed within a period of five years from the completion of the development a new tree or shrub or equivalent number of trees or shrubs as the case may be, be planted and properly maintained in a position or positions as first approved by the Chief Planning Officer. Reason: In the interests of the visual amenities of the area and to ensure the creation of a pleasant environment for the development.

That all planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting season following the occupation of the buildings or the completion of the development, whichever is the sooner, and any trees or plants which within a period of five years die, are removed or become seriously damaged shall be replaced in the next planting season with others of similar size and species, unless the Chief Planning Officer gives written consent to any variations. Reason: In the interests of the visual amenities of the area and to ensure the creation of a pleasant environment for the development.

That no development shall take place until the trees on the site which are to be retained and which are adjacent to or within the development area, have been protected during building operations by means of a protective fence around the edge of the canopy of the trees in accordance with B.S. 5837: 1991, and with the written requirements (copy attached) of the Chief Planning Officer relating to the protection of trees. Furthermore, no works or storing of plant or materials shall be carried out within the fenced area. Reason: To ensure the protection of trees on the land and to preserve the amenities of the locality.

That samples of the exterior materials proposed to be used shall be submitted to and approved in writing by the Chief Planning Officer prior to the start of work on the site. Reason: To ensure the materials are compatible with the surrounding development.

That the building shall be re-sited a minimum distance of 2 metres from the eastern boundary of the site. Reason: In the interests of the amenities of the neighbouring property.

That the land that comprises the contractor's access shall be reinstated following completion of building work on this development. Reason: In the interests of the visual amenities of the area.

That the windows on the eastern elevation of the building will be fixed lights and double glazed for sound reduction purposes in accordance with details to be submitted and agreed by the Chief Planning Officer before the building is brought into use. Reason: In the interests of the amenities of the neighbouring properties.

That any door on the eastern elevation shall be fitted with soundproof seals and locked using a breakable glass fire alarm release system. Reason: To avoid doors being opened in hot weather for ventilation in the interests of the amenities of the neighbouring properties.
