Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.
That the dwelling hereby permitted shall not be occupied until the Waiting and Parking Traffic Order relating to the parking area to the front (north) of the site has been modified and the works associated with the modification have been implemented, with written confirmation of this modification having been submitted to the Local Planning Authority.
Reason: To ensure adequate on-site parking to serve the development and the adjoining
dwelling is provided and accessed at all times in accordance with the
requirement of policy G11 and Appendix of the Council's adopted South
Oxfordshire Local Plan.
That, prior to the commencement of any work in connection with the development hereby permitted, details of the slab level of the dwelling shall be submitted to and approved in writing by the Local Planning Authority. Thereafter, the development shall not proceed other than in accordance with the approved slab level details.
Reason: To ensure that the development is not unneighbourly and that the dwelling has a
satisfactory appearance in the street scene in accordance with policy H4 of the
Council's adopted South Oxfordshire Local Plan.
That prior to the commencement of any other development to which this permission relates, the means of access between the land and the highway shall be formed, laid out and constructed strictly in accordance with the specification of the means of access attached hereto, and all ancillary works therein specified shall be undertaken strictly in accordance with the said specification.
Reason: In the interests of highway safety and convenience in accordance with policy G10
of the Council's adopted South Oxfordshire Local Plan.
That samples of the materials to be used for the external walls and roofs shall be submitted to and approved in writing by the Local Planning Authority before any development commences.
Reason: To ensure that the details of the development are satisfactory in accordance with
policies H4 and G8 of the Council's adopted South Oxfordshire Local Plan.
That, prior to the occupation of the dwelling hereby permitted, the rear garden shall be laid out in accordance with plan ref: SM/1/12A received on 11 January 2001 submitted in connection with application P00/S0708 and shall thereafter remain in accordance with this plan unless otherwise agreed in writing by the Local Planning Authority.
Reason: To ensure that a satisfactory standard of amenity space is provided for the proposed
dwelling in accordance with policy G8 of the Council's adopted South Oxfordshire
Local Plan.
That, prior to the first occupation of the dwelling hereby permitted, parking shall be constructed, surfaced and laid out, as shown on drawing no. SM/1/11A; and such parking provision shall thereafter be retained for both the new and existing dwelling.
Reason: To comply with the Local Planning Authority's vehicle parking standards and to
protect local amenities in accordance with policies G11 and H4 of the Council's
adopted South Oxfordshire Local Plan.
That, prior to the commencement of the development, details of the boundary treatments shall be submitted to and approved in writing by the Local Planning Authority. Thereafter the boundary treatments shall be constructed as approved prior to the first occupation of the new dwelling hereby permitted.
Reason: To ensure that the development is not unneighbourly in accordance with policy H4
of the Council's adopted South Oxfordshire Local Plan.
That no development shall take place until there has been submitted to and approved in writing by the Local Planning Authority a scheme of soft landscaping which shall include indications of all existing trees and hedgerows on the land, and details of any to be retained, together with measures for their protection in the course of development.
Reason: To protect local amenities in accordance with policy H4 of the Council's adopted
South Oxfordshire Local Plan.
That all planting, seeding or turfing comprised in the approved scheme of landscaping shall be carried out in the first planting and seeding seasons following the occupation of the buildings or the completion of the development, whichever is the sooner; and any trees or plants which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation.
Reason: To help to assimilate the development into its surroundings in accordance with
policy H4 of the Council's adopted South Oxfordshire Local Plan.
That the bathroom window at the first floor level in the south (rear) elevation of the dwelling hereby permitted shall be glazed in obscure glass prior to first occupation of the new dwelling and shall thereafter be retained as such.
Reason: To ensure that the development is not unneighbourly in accordance with policy H4
of the Council's adopted South Oxfordshire Local Plan.
That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order) no additional windows or doors shall be constructed in the east or west (side) elevations of the dwelling hereby permitted other than those expressly authorised by this permission.
Reason: To ensure that the development is not unneighbourly.
That, notwithstanding the provisions of Article 3 of, and Classes Classes A, B, C, D and E of Part 1 of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order), no development within Classes A, B, C, D and E of Part 1 of Schedule 2 to the Order shall be carried out on the land unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof.
Reason: To protect the amenity of the neighbours and the character of the area in
accordance with policies G8 and H4 of the Council's adopted South Oxfordshire
Local Plan.
