Conditions / Refusal Reasons
That having regard to its location adjacent to the boundary of the site and to the south of
68 Bell Street, the erection of a two storey dwelling in this location would be detrimental to the residential amenities of 68 Bell Street on account of its oppressive and overbearing impact on that property and its garden. Therefore the development would be contrary to the provisions of the Council's adopted South Oxfordshire Local Plan, particularly policy H4.
That in a decision letter dated 22 December 2000, the Inspector appointed to determine an appeal (APP/Q3115/A/00/1049294) against the Council's decision to refuse planning permission (P00/S0262) for the erection of a detached house and garage on the application site stated in paragraph 13. "I find the design and scale of the proposal would not be sufficiently in sympathy with the established character of the area so that it would not meet objective (i) of Policy CON10". In the opinion of the Local Planning Authority this issue
has not been addressed in that the design and scale of the new dwelling remains very similar to that dismissed at appeal and therefore fails to preserve or enhance the character and appearance of the Conservation Area. As such the development would be contrary to policies H4, G8 and CON10.
