Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.

That samples of the materials to be used for the external walls and roofs and boundary walls shall be submitted to and approved in writing by the Local Planning Authority before any development commences. Reason: To ensure that the details of the development are satisfactory and to accord with policy H12 of the Council's adopted South Oxfordshire Local Plan.

That all the walls of the development hereby approved shall be constructed using a Flemish bond. Reason: To ensure the details of the development are satisfactory and to accord with policies G8 and CON8 of the Council's adopted South Oxfordshire Local Plan.

That development shall not begin until a detailed specification of the type, design and external finish of all windows, external doors and rainwater goods has been submitted to and approved in writing by the Local Planning Authority. Reason: To ensure that the details of the development are satisfactory and to accord with policy CON10 of the Council's adopted South Oxfordshire Local Plan.

That a scheme for the landscaping of the site, including the planting of live trees and shrubs, the treatment of the access road and hardstandings, and the provision of boundary fencing and screen walling shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help assimilate the development into its surroundings and to accord with policy G9 of the Council's adopted South Oxfordshire Local Plan.

That a full archaeological watching brief shall be carried out during the period of construction works by a professionally competent archaeological organisation and in accordance with details which shall have been submitted to and approved in writing by the Local Planning Authority before development commences. The brief shall include the recording of any archaeological features revealed, limited archaeological excavation and the retrieval of artefactual evidence. Reason: As the site is of archaeological importance in accordance with Policy CON16 of the Council's adopted South Oxfordshire Local Plan.

That, upon first use of the proposed access the existing access serving The Lilacs shall be closed by the erection of a 0.6m high brick wall and the public highway and kerb line shall be reinstated in accordance with a scheme which has been first submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of highway safety and convenience and to accord with policies G10 and CON10 of the Council's adopted South Oxfordshire Local Plan.

That, upon first use of the proposed access the existing access serving Brook House shall be closed by the erection of wall and railings in accordance with a scheme which shall have first been submitted to and approved in writing by the Local Planning Authority, and the public highway and kerb line shall be reinstated in accordance with a scheme which has been first submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of highway safety and convenience and to accord with policies G10 and CON10 of the Council's adopted South Oxfordshire Local Plan.

That no dwelling shall be occupied until that part of the service road which provides access to it has been constructed in accordance with the approved plans. Reason: In the interests of highway safety and to provide reasonable access during construction works on adjoining land in accordance with Policy G10 of the Council's adopted South Oxfordshire Local Plan.

That prior to the commencement of its use the means of access to which this permission relates shall be formed, laid out and constructed strictly in accordance with the Oxfordshire County Council's specification for the construction of estate streets and all ancillary works therein specified shall be undertaken strictly in accordance with the said specification. Reason: In the interests of highway safety and convenience in accordance with Policy G10 of the Council's adopted South Oxfordshire Local Plan.

That prior to the commencement of any other development to which this permission relates, the means of access between the land and the highway shall be formed, laid out, constructed and made available for use in all respects to the satisfaction of the Local Planning Authority. Reason: In the interests of highway safety and convenience in accordance with Policy G10 of the Council's adopted South Oxfordshire Local Plan.

That the parking provision shall be as shown on the deposited drawing, reference 17B all constructed, surfaced and laid out, and thereafter retained and maintained. Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities in accordance with Policy G11 of the Council's adopted South Oxfordshire Local Plan.

That no dwelling shall be occupied until the whole of the roads and footpaths shown on the layout plan accompanying the application, and all surface water drainage works, have been laid out and constructed in accordance with the Oxfordshire County Council Design Guide for Residential Roads and the specification for the construction of works for housing development. Reason: In the interests of highway safety and convenience in accordance with Policy G10 of the Council's adopted South Oxfordshire Local Plan.

Prior to the commencement of development a detailed site investigation shall be carried out to establish if the site is contaminated, to assess the degree and nature of the contamination present, and to determine its potential for the pollution of the water environment. The method and extent of the site investigation shall be agreed with the Local Planning Authority prior to the commencement of the work. Details of appropriate measures to present pollution of groundwater and surface water shall then be submitted to and approved in writing by the Local Planning Authority before development commences. The development shall then proceed in strict accordance with the measures approved. Reason: To prevent pollution of the water environment in accordance with Policy G7 of the Council's adopted South Oxfordshire Local Plan.

That prior to the commencement of the development a scheme for the protection of the surface water culvert shall be submitted to and approved in writing by the Local Planning Authority. The development shall be carried out in all respects in accordance with the approved scheme. Reason: In the interests of public health and to avoid pollution and to accord with policy G7 of the Council's adopted South Oxfordshire Local Plan.

That surface water shall not be disposed of other than in accordance with a detailed surface water drainage scheme which shall first have been submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of public health in accordance with Policy G7 of the Council's adopted South Oxfordshire Local Plan.

That no soakaways shall be constructed such that they penetrate the water table, and they shall not in any event exceed 1 metre in depth below existing ground level. Furthermore no soakaways shall be constructed in contaminated ground. Reason: To prevent the pollution of groundwater and to accord with Policy G7 of the Council's adopted South Oxfordshire Local Plan.

That development shall not begin until a scheme for the disposal of foul sewage has been submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of public health and to avoid pollution in accordance with Policy G7 of the Council's adopted South Oxfordshire Local Plan.

That notwithstanding the provisions of Article 3 of, and Classes A, B, C, D and E of Part 1 of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order), no development within Classes A, B, C, D and E of Part 1 of Schedule 2 to the Order shall be carried out on the land unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof. Reason: To protect local amenities and to accord with Policies G1, G8 and H4 of the Council's adopted South Oxfordshire Local Plan.

That the B1 building at the rear of the site shall be removed together with all resulting materials prior to the commencement of the erection of any of the dwellings. Reason: To safeguard the character of the area and to accord with policy G1 of the Council's adopted South Oxfordshire Local Plan.
