Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.
That the materials to be used for the plinth walls of the conservatory shall be of the same colour, type and texture as those used on the existing building, unless otherwise agreed by the Local Planning Authority.
Reason: To ensure that the details of the development are satisfactory in accordance with
policy H4 of the Council's adopted South Oxfordshire Local Plan.
That prior to the commencement of any other development to which this permission relates, the means of access between the land and the highway shall be formed, laid out and constructed strictly in accordance with the specification of the means of access attached hereto, and all ancillary works therein specified shall be undertaken strictly in accordance with the said specification.
Reason: In the interests of highway safety and convenience in accordance with policy G10
of the Council's adopted South Oxfordshire Local Plan.
That the dwelling shall not be occupied until the parking provision has been constructed, surfaced and laid out, as shown on drawing no. HBRH/11C; and such parking provision shall be retained thereafter.
Reason: To comply with the Local Planning Authority's vehicle parking standards and to
protect local amenities in accordance with policy G11 of the Council's adopted
South Oxfordshire Local Plan.
That except for those shown to be removed on drawing no HBRH/11C or insofar as may be otherwise agreed in writing by the Local Planning Authority, all trees, shrubs and hedges on the land shall be retained and protected during the course of the development and for a period of five years following the completion of the development. Any trees, shrubs or plants which within that period die, are removed or become seriously damaged or diseased, shall be replaced in the next planting season with others of a similar size and species, unless the Local Planning Authority gives written consent to any variation.
Reason: To safeguard the character of the area in accordance with policies C16 and G8 of
the Council's adopted South Oxfordshire Local Plan.
That the existing hedge along the whole of the southern boundary with Peppard Lane of the land shall be allowed to grow and be retained and properly maintained at a height of not less than 3 metres, and that any plant which may die or be seriously damaged or destroyed within three years of the completion of the development shall be replaced and the replacement shall be properly maintained.
Reason: To help to assimilate the development into its surroundings in accordance with
policy C16 of the Council's adopted South Oxfordshire Local Plan.
That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order) no windows shall be constructed in the east elevation of the building other than those expressly authorised by this permission.
Reason: To ensure that the development is not unneighbourly in accordance with
policies H4 and H11 of the Council's adopted South Oxfordshire Local Plan.
That notwithstanding the provisions of Article 3 of, and Classes A - C of Part 1 of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order), no development within Classes A - C of Part 1 of Schedule 2 to the Order shall be carried out on the land unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof.
Reason: To protect local amenities in accordance with policies G8, H4 and H11 of the
Council's adopted South Oxfordshire Local Plan.
That the bedroom windows in the east (side) elevation and north (front) elevation of the dwelling hereby permitted shall be glazed in obscure glass prior to first occupation of the premises and shall thereafter be retained as such.
Reason: To ensure that the development is not unneighbourly in accordance with
policies G8 and H4 of the Council's adopted South Oxfordshire Local Plan.
