Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.
That development shall not begin until a detailed specification of the type, design and external finish of all windows, external doors and rainwater goods has been submitted to and approved in writing by the Local Planning Authority.
Reason: To ensure that the details of the development preserve the character and appearance
of the Conservation Area in accordance with Policies H4, G8, CON10 and CON15
of the adopted South Oxfordshire Local Plan.
That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order) no windows shall be constructed at first floor level in the north west and south east (side) elevations of the dwelling other than those expressly authorised by this permission.
Reason: To protect the privacy of neighbours in accordance with Policy H4 of the adopted
South Oxfordshire Local Plan.
That the dwelling shall not be occupied until space has been laid out within the site for two cars to be parked and for vehicles to turn so that they may enter and leave the site in forward gear; and such parking and turning space shall be retained thereafter.
Reason: To ensure that adequate space is provided for the parking and turning of vehicles in
accordance with Policy G11 of the adopted South Oxfordshire Local Plan.
That no development shall take place until a scheme of hard and soft landscaping of the site has been submitted to and approved in writing by the Local Planning Authority, which shall include the treatment of the access road, driveways and hardstandings and the provision of any boundary treatments. Thereafter the approved hard landscaping and boundary treatments shall be implemented prior to the first occupation of the dwelling.
Reason: To help to assimilate the development into its surroundings in accordance with
Policies G8 and G9 of the adopted South Oxfordshire Local Plan.
That all planting, seeding or turfing comprised in the approved scheme of landscaping shall be carried out in the first planting and seeding seasons following the occupation of the buildings or the completion of the development, whichever is the sooner; and any trees or plants which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation.
Reason: To help to assimilate the development into its surroundings in accordance with
Policies G8 and G9 of the adopted South Oxfordshire Local Plan.
That except insofar as may be otherwise agreed in writing by the Local Planning Authority, all trees, shrubs and hedges on the land shall be retained and protected during the course of the development and for a period of five years following the completion of the development. Any trees, shrubs or plants which within that period die, are removed or become seriously damaged or diseased, shall be replaced in the next planting season with others of a similar size and species, unless the Local Planning Authority gives written consent to any variation.
Reason: To help to assimilate the development into its surroundings in accordance with
Policies G8 and G9 of the adopted South Oxfordshire Local Plan.
That prior to the commencement of the work in connection with the development hereby permitted details of a scheme for repairs and improvements to the boundary wall abutting the public footpath shall be submitted to and approved in writing by the Local Planning Authority. Thereafter the approved scheme shall be implemented prior to the first occupation of the dwelling.
Reason: To enhance the appearance of the Conservation Area in accordance with
Policies CON10 and CON15 of the Council's adopted South Oxfordshire Local
Plan.
That, notwithstanding the provisions of Article 3 of, and Classes A, C, D and E of Part 1 of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order), no development within Classes A, C, D and E of Part 1 of Schedule 2 to the Order shall be carried out on the land unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof.
Reason: In order to protect the character and appearance of the Conservation Area and the
amenity of neighbours in accordance with Policies H4, CON 10 and CON 15 of the
Council's adopted South Oxfordshire Local Plan.
That prior to the occupation of the dwelling hereby permitted the means of access between the land and the highway shall be formed, laid out and constructed strictly in accordance with the submitted plan drawn at a scale of 1:500 and the attached specification and all ancillary works therein shall be undertaken strictly in accordance with the said specification and deposited plan.
Reason: In the interests of highway safety and convenience in accordance with Policy G10
of the adopted South Oxfordshire Local Plan.
That prior to the first occupation of the dwelling hereby permitted the footway along
Brook Street as shown on the submitted plans shall be dedicated to the Highway Authority.
Reason: In the interests of pedestrian safety and convenience in accordance with Policy G10
of the adopted South Oxfordshire Local Plan.
That the garage hereby permitted shall be retained for the parking of vehicles and shall not be adapted for living purposes.
Reason: To comply with the Local Planning Authority's vehicle parking standards in
accordance with Policy G11 of the adopted South Oxfordshire Local Plan.
