Temporary planning permission (15 years) for the erection of temporary structures and the change of use of land and buildings for up to 35 public events per annum together with ancillary work of preparation and clearing up, including a maximum 20 opera performances and 3 dress rehearsals and up to 12 other public events, with associated parking and ancillary catering and toilet facilities. (As amplified by letter dated 19 October 2001 and drawing no. CL3980/14A and as further amplified by letter dated 22 October 2001 and drawing no. 3980/14A and by Drawing No. CL3980/16 accompanying Agent's letter dated 20 December 2001).
Conditions / Refusal Reasons
The uses specified in this permission shall be discontinued on 30 April 2017 unless a fresh application has been submitted to and approved in writing by the Local Planning Authority.
Reason: In view of the temporary nature of the development in accordance with Policy G1 of the
Council's adopted South Oxfordshire Local Plan.
The use hereby permitted shall be carried on only by Garsington Opera Limited and Mr & Mrs L V Ingrams.
Reason: To safeguard the architectural and historic character and appearance of the listed
building and the amenity of the Garsington Conservation Area in accordance with
Policy G1 of the Council's adopted South Oxfordshire Local Plan.
The total number of public events to be held on the site in any calendar year shall not exceed 35 days duration and shall include no more than 20 full performances and 3 dress-rehearsals associated with the Opera Festival
Reason: To safeguard the architectural and historic character and appearance of the listed
building and the amenity of the Garsington Conservation Area in accordance with
Policy G1 of the Council's adopted South Oxfordshire Local Plan.
The range of public events hereby permitted shall be confined solely to the Opera Festival, garden open days, a single barn dance, concerts in The Barn, village fetes and theatrical performances, as defined in the details accompanying the application, and no type of event other than the Opera Festival shall be held on more than six occasions in any one calendar year.
Reason: To safeguard the architectural and historic character and appearance of the listed
building and the amenity of the Garsington Conservation Area in accordance with
Policy G1 of the Council's adopted South Oxfordshire Local Plan.
A detailed calendar of the public events to be held each season shall be supplied to the Local Planning Authority by 31 March of that year and shall include start and finish dates for setting up and dismantling of the Opera Festival.
Reason: To safeguard the architectural and historic character and appearance of the listed
building and the amenity of the Garsington Conservation Area in accordance with
Policy G1 of the Council's adopted South Oxfordshire Local Plan.
No amplified music or speech shall take place at any Opera or at any theatrical performance, without the written consent of the Local Planning Authority.
Reason: To protect local amenities in accordance with Policies G1 and G7 of the Council's
adopted South Oxfordshire Local Plan.
No Opera performance, orchestral rehearsal or dress rehearsal shall take place until the acoustic screens have been installed in the positions indicated on Plan No CL/3980/13, the canopy extended and the curtains comprised within the acoustic screens are fully in position. Such acoustic screens and curtains shall be of a design and form of construction, details of which shall have first been submitted to and approved in writing by the Local Planning Authority, and shall be erected and maintained in accordance with a specification which shall have first been submitted to and approved in writing by the Local Planning Authority.
Reason: To protect local amenities in accordance with Policies G1 and G7 of the Council's
adopted South Oxfordshire Local Plan.
The curtains within the acoustic screens shall be lowered/retracted by 11pm on the evening of each opera performance dress rehearsal or other musical rehearsal, and shall otherwise only be raised for each occasion of an opera performance, dress rehearsal or any other musical rehearsal.
Reason: To protect local amenities in accordance with Policies G1 and G7 of the Council's
adopted South Oxfordshire Local Plan.
All Opera performances, including dress rehearsals, shall finish no later than 10:15pm.
Reason: To protect local amenities in accordance with Policies G1 and G7 of the Council's
adopted South Oxfordshire Local Plan.
All non-dress rehearsals shall commence no earlier than 11am and shall finish no later than 8pm with the exception that on no more than three occasions, such rehearsals shall finish no later than 10:15pm and no such rehearsal shall take place more than 7 days before the first dress rehearsal.
Reason: To protect local amenities in accordance with Policies G1 and G7 of the Council's
adopted South Oxfordshire Local Plan.
The Opera festival, including setting up and clearing away periods, shall take place within a consecutive eighty day period in each calendar year and the setting up shall not exceed 25 consecutive working weekdays.
Reason: To protect local amenities in accordance with Policies G1 and G7 of the Council's
adopted South Oxfordshire Local Plan.
All work associated with the setting up, dismantling and removal of the temporary structures hereby permitted shall only take place between the hours of 8:00am and 6:00pm Monday to Friday, and no work shall take place during weekends and Bank Holidays.
Reason: To protect local amenities in accordance with Policies G1 and G7 of the Council's
adopted South Oxfordshire Local Plan.
Any work associated with Opera performances, dress rehearsals and the three evening rehearsals referred to in condition 10, shall only take place between the hours of 8am and 11pm and any work associated with other rehearsals shall only take place between the hours of 8am and 7pm.
Reason: To protect local amenities in accordance with Policies G1 and G7 of the Council's
adopted South Oxfordshire Local Plan.
No work required in plotting or adjusting the lighting shall take place after 11.00 pm in the evening or before 8.00 am the following morning and after 9.00 pm no power tools shall be used on the site.
Reason: To protect local amenities in accordance with Policies G1 and G7 of the Council's
adopted South Oxfordshire Local Plan.
All temporary structures erected in connection with the Opera Festival shall be dismantled and the materials removed from the land. Any materials which are not removed from the land shall otherwise be stored in existing buildings within the application area.
Reason: To protect the openness of the Green Belt in accordance with Policy GB3 of the
Council's adopted South Oxfordshire Local Plan.
No vehicles in connection with the use hereby permitted shall be allowed to park in any other field except the field identified on plan CL/3980/12A.
Reason: To protect the openness of the Green Belt in accordance with Policy GB3 of the
Council's adopted South Oxfordshire Local Plan.
That provision for the parking of vehicles used by the public for each public performance hereby permitted shall be made within the field identified on drawing number CL/3980/12A and access/egress to and from this area shall only be permitted via Gate 4 as indicated on the drawing.
Reason: In the interests of highway safety and convenience in accordance with Policy G10 of the
Council's adopted South Oxfordshire Local Plan.
All vehicles associated with the public performances hereby permitted shall leave the car park before 11.00 pm, except for staff vehicles parked in the defined area.
Reason: To protect local amenities in accordance with Policies G1 and G7 of the Council's
adopted South Oxfordshire Local Plan.
Provision shall be made within the field used for car parking for an area to be separately identified for the parking of staff vehicles only associated with the public performances relating to the Opera Festival hereby permitted, in an area which shall first be agreed in writing with the Local Planning Authority.
Reason: To protect the openness of the Green Belt in accordance with Policy GB3 of the
Council's adopted South Oxfordshire Local Plan.
On the occasions of any barn dance or the 3 opera cast parties, which shall previously have been notified to the Local Planning Authority as required by Condition 5, all vehicles parked in the defined area shall leave the field used for car parking before 1:00am on the following morning.
Reason: To protect local amenities in accordance with Policies G1 and G7 of the Council's
adopted South Oxfordshire Local Plan.
No Opera performance or dress rehearsal shall take place except where (a) a sign approved by the Local Planning Authority and in a location approved by the Local Planning Authority is displayed at the exit from the car park requiring traffic to turn right and at Gate 3 to deter traffic from using this gate (b) a steward is provided to direct traffic.
Reason: In the interests of highway safety and convenience in accordance with Policy G10 of the
Council's adopted South Oxfordshire Local Plan.
That the maximum size of the auditorium shall not exceed the limits shown on drawing No CL/3980/16 unless otherwise agreed in writing by the Local Planning Authority and shall only be erected in the position indicated on the site.
Reason: To protect local amenities in accordance with Policies G1 and G7 of the Council's
adopted South Oxfordshire Local Plan.
