Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990. Related application(s): P11/W0033/DIS

That samples of the materials to be used for the external walls and roofs shall be submitted to and approved in writing by the Local Planning Authority before any development commences. Reason: To safeguard the character of the area in accordance with Policy H12 of the adopted South Oxfordshire Local Plan.

That development shall not begin until detailed specifications of the designs, materials and external finishes of all windows, dormers, external doors, eaves/fascias and rainwater goods have been submitted to and approved in writing by the Local Planning Authority. Reason: To safeguard the character of the area in accordance with Policy H12 of the adopted South Oxfordshire Local Plan.

That no development shall take place until comprehensive details of proposed landscaping works have been submitted to and approved in writing by the Local Planning Authority. The details shall include any features to be retained; planting proposals including schedules of plants, species, numbers and densities; all hard surfaces, means of enclosure including height, materials and designs of walls and fences. Reason: To help to assimilate the development into its surroundings in accordance with Policy G9 of the adopted South Oxfordshire Local Plan.

That the approved landscape works shall be carried out within 12 months of the commencement of development. Except as may otherwise be agreed in writing by the Local Planning Authority any vegetation which dies, exhibits die back or is damaged within 5 years of implementation shall be replaced with a specimen of the same species and size. Reason: To help to assimilate the development into its surroundings in accordance with Policy G9 of the adopted South Oxfordshire Local Plan.

Concurrent with the submission of comprehensive details of proposed landscaping works, a maintenance schedule and long term management plan for the soft landscaping works shall be submitted to and approved in writing by the Local Planning Authority. The schedule and plan shall be implemented as approved. Reason: To help to assimilate the development into its surroundings in accordance with Policy G9 of the adopted South Oxfordshire Local Plan.

That prior to the commencement of its use the means of access to which this permission relates shall be formed, laid out and constructed strictly in accordance with the Oxfordshire County Council's specification for the construction of estate streets and all ancillary works therein specified shall be undertaken strictly in accordance with the said specification. Reason: In the interests of highway safety and convenience in accordance with Policy G10 of the adopted South Oxfordshire Local Plan.

That the whole of the roads and footpaths shown on the layout plan accompanying the application, and all surface water drainage works, be laid out and constructed in accordance with the Oxfordshire County Council Design Guide for Residential Roads and the specification for the construction of works for housing development, and in all respects to the satisfaction of the Local Planning Authority. Reason: In the interests of highway safety and convenience in accordance with Policy G10 of the adopted South Oxfordshire Local Plan.

That work be not commenced on the erection of any dwellings until the carriageways only serving the whole of that portion of the development under construction, have been laid out and constructed to the above mentioned specification, save for wearing course and kerbing. Reason: In the interests of highway safety, to provide protection of the subgrade and to ensure adequate clear running surfaces which will protect adjoining public highways from droppings of spoil, mud, etc in accordance with Policy G10 of the adopted South Oxfordshire Local Plan.

That within six months of the substantial completion of the 112th dwelling, all roads, footpaths and their drainage shall be completed including their final surfacing. Reason: To ensure a satisfactory standard of amenity for residents in accordance with Policy H11 of the adopted South Oxfordshire Local Plan.

That a detailed scheme of traffic calming works and the phasing of the works shall be submitted to and approved in writing by the Local Planning Authority before development begins. The works shall be carried out as approved. Reason: In the interests of highway safety and convenience in accordance with Policy G10 of the adopted South Oxfordshire Local Plan.

That a detailed scheme for a safe cycleway from Barley Close to the south western corner of the site shall be submitted to and approved in writing by the Local Planning Authority before development begins. The works shall be carried out as approved prior to first occupation of no more than 140 dwellings and shall thereafter be retained and maintained for public access between Barley Close and the site boundary. Reason: To provide for the needs of residents and for the future provision of a link to Cholsey Station in accordance with Policies G10, G11 and H11 of the adopted South Oxfordshire Local Plan

That a detailed scheme for covered secure cycling parking for occupiers of the proposed flats shall be submitted to and approved in writing by the Local Planning Authority. Reason: To provide for the needs of residents in accordance with Policies G11 and H11 of the adopted South Oxfordshire Local Plan.

That no dwelling shall be occupied until the car parking and approved cycle parking spaces to serve that dwelling have been provided. The facilities shall thereafter be retained. Reason: In the interests of highway safety and convenience in accordance with Policies G11 and H11 of the adopted South Oxfordshire Local Plan.

That the garage accommodation shall be retained as such and shall not be adapted for living purposes without the prior permission of the Local Planning Authority. Reason: In the interests of highway safety and convenience in accordance with Policies G11 and H11 of the adopted South Oxfordshire Local Plan.

That development shall not begin until a scheme for the disposal of foul sewage has been submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of public health and to avoid pollution in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.

That details of surface water drainage works shall be submitted to and approved in writing by the Local Planning Authority prior to the development commencing. Reason: In the interests of public health and to avoid pollution in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.

Before the development is commenced a detailed site investigation shall be carried out to establish if the site is contaminated, to assess the degree and nature of the contamination present, and to determine its potential for the pollution of the water environment. The method and extent of this site investigation shall be agreed with the Planning Authority prior to commencement of the work. Details of appropriate measures to remediate the contamination and to prevent pollution of groundwater and surface water, including provisions for monitoring, shall then be submitted to and approved in writing by the Planning Authority before development commences. The development shall then proceed in strict accordance with the measures approved. Reason: To prevent pollution of the water environment and in the interests of public health in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.

That no soakaways shall be constructed in contaminated ground. Reason: To prevent pollution of groundwater in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.

That except as may otherwise be agreed in writing by the Local Planning Authority no structure shall be constructed or erected at any time within 10 metres of the north bank of the Bradfords Brook. Reason: To allow for maintenance of the watercourse and the development of a wildlife corridor in accordance with Policies G7, G16 and C15 of the adopted South Oxfordshire Local Plan.

That a full archaeological watching brief shall be carried out during the period of construction works in accordance with details and by a professionally competent archaeological organisation which shall have been submitted to and approved in writing by the Local Planning Authority before development commences. The brief shall include the recording of any archaeological features revealed, limited archaeological excavation and the retrieval of artefactual evidence. Reason: As the site is of archaeological importance in accordance with Policy Con 18 of the adopted South Oxfordshire Local Plan.

That the building envelope shall be constructed so as to meet internal noise levels of:- Living areas 55 dB LAeq (daytime) Bedrooms 30 dB LAeq, 45 LA max (night-time) These standards shall be met with windows partially open or with acoustic ventilation. Reason: To ensure satisfactory standards of residential amenity in accordance with Policy H11 of the adopted South Oxfordshire Local Plan.

That a detailed scheme showing the precise location and design of a fence to be erected on the western boundary of the site and a scheme of phasing shall be submitted to and approved in writing by the Local Planning Authority. The fence shall be erected in accordance with the approved details and thereafter retained and properly maintained. Reason: To provide reasonable standards of amenity, security and safety for occupiers of adjacent dwellings and to ensure that the development does not prejudice safe operation of a railway service on adjacent land in accordance with Policy T9 of the Oxfordshire Structure plan 2011 and Policies G14 and H11 of the adopted South Oxfordshire Local Plan.

That notwithstanding details shown on the submitted drawings, details of the siting and design of bin stores shall be submitted to and approved in writing by the Local Planning Authority. The bin stores shall be erected prior to first occupation of the dwellings they are designed for. Reason: To safeguard the amenity of the area and convenience for users of the facility in accordance with Policies G8 and H11 of the adopted South Oxfordshire Local Plan.

That compensatory flood storage and dry access route works, if required, shall be carried out in accordance with details which shall have been submitted to and approved in writing by the Local Planning Authority before development commences. Reason: To alleviate the risk of flooding and to provide for the safety of residents in the event of flooding on site in accordance with Policy G16 of the adopted South Oxfordshire Local Plan.

That notwithstanding details shown on the submitted plans details of the finished floor levels of all dwellings shall be submitted to and approved in writing by the Local Planning Authority. Reason: To ensure that the dwellings are not liable to be affected by flooding in accordance with Policy G16 of the adopted South Oxfordshire Local Plan.

That no spoil or materials shall be stored on that part of the site lying within the area liable to flood. Reason: To prevent the increased risk of flooding due to impedance of flood flows and reduction of flood storage capacity.

That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 or any order revoking and re-enacting that order, no extension, building or wall except as hereby permitted shall be erected on land shown edged red on the attached plan reference P00/W0813-A unless a planning permission shall have been granted therefor. Reason: To ensure that such development does not increase the risk of flooding due to impedance of flood flows and reduction in flood storage capacity in accordance with Policy G16 of the adopted South Oxfordshire Local Plan.
