Conditions / Refusal Reasons
The development hereby permitted shall be carried out solely in accordance with the approved submitted details except as modified by these conditions and unless otherwise agreed by the Mineral Planning Authority in writing. Reason: For the avoidance of doubt and to ensure that the development is carried out in accordance with the approved plans and details.

The extraction of sand and gravel hereby permitted shall cease on or before 30 June 2005 and all plant, machinery, haul roads and hardstanding shall be removed and the site and adjoining blue land restored in accordance with approved drawing number 97033/BF/6a by 31 August 2006 unless otherwise agreed in writing by the Mineral Planning Authority. Reason: To comply with Schedule 5, paragraph 1 of the Town and Country Planning Act 1990 and to ensure that the site and adjoining blue land is restored. Drawing number 97033/BF/6a supersedes restoration details previously approved for the blue land area.

The means of access and haul roads shall not be other than as shown on approved plans 97033/BF/2 and 97033/BF/3 and shall be maintained in a condition free from potholes for the duration of the development. Reason: In the interests of highway safety and local amenity.

Before development commences construction details of the haul road shall be submitted for the written approval of the Mineral Planning Authority. The approved details shall be implemented for the duration of the development. Reason: To prevent serious damage occurring to the land.

The wheels and chassis of loaded vehicles leaving the site shall be sufficiently clean as to prevent the deposit of material onto the public highway. Reason: In the interests of highway safety and local amenity.

With the exception of works necessary arising from emergency situations and pumping for the purposes of dewatering and unless otherwise agreed in writing by the Mineral Planning Authority lorries shall not enter or leave the site, plant shall not be operated and operations shall not take place: a. other than between 0700 hours and 1800 hours Mondays to Fridays and 0700 hours to 1300 hours on Saturdays; and b. at any time on Sundays, Bank Holidays and Saturdays immediately following Bank Holiday Fridays. Reason: In order to protect the amenities of the area.

No reversing bleepers or other means of warning of reversing vehicles shall be fixed to, or used on any mobile plant except in accordance with details as agreed in writing by the Mineral Planning Authority. Reason: To protect local residents from unreasonable noise intrusion.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995, or any Order amending, replacing or re-enacting that Order, no buildings, plant machinery or structures (whether of fixed or portable design) shall be erected or placed on site other than as shown on the approved plans and without the prior written approval of the Mineral Planning Authority. Reason: In the interests of the visual amenity of the area.

Before development commences a system of muffling the sound of dewatering pumps shall be submitted to the Mineral Planning Authority for written approval. The approved system shall be implemented for the duration of the development unless otherwise agreed in writing by the Mineral Planning Authority. Reason: In the interest of minimising noise disturbance.

Prior to commencement of development a survey point shall be established marking ground level, and shall be agreed in writing by the Mineral Planning Authority. Ground level shall not be raised above this height throughout the duration of development or on completion of restoration unless otherwise agreed in writing by the Mineral Planning Authority. Reason: In order to prevent increased risk of flooding due to impedance of flood flows and reduction of flood storage capacity.

No pumping from the excavations shall take place whilst the adjoining watercourses are running bank full. Reason: To prevent the increased risk of flooding.

No bunds shall be constructed except in accordance with approved plans numbered 97033/BF/3a and 97033/BF/3b unless otherwise agreed in writing by the Mineral Planning Authority. Reason: In order to prevent increased risk of flooding due to impedance of flood flows and reduction of flood storage capacity.

No watercourse shall be incorporated into or directly connected with the working. Reason: To prevent pollution of the water environment.

Unless otherwise agreed in writing by the Mineral Planning Authority no working shall take place and no vehicles, plant or associated machinery shall be placed or moved on land within 16 metres of the edge of the River Thames as shown on approved plans numbered 97033/BF/3a and 97033/BF/3b. No working shall take place unless any such buffer zones have been fenced off in accordance with details that have been submitted to and approved by the Mineral Planning Authority in writing. Reason: To maintain the character of the watercourse and provide undisturbed refuges for wildlife using the river corridor.

Handling and movement of soil shall not be carried out other than when the material is in a dry and friable condition. No vehicle movements over soil shall take place except for the express purpose of soil stripping or replacement operations and then only when the soils are in a dry or friable condition. Reason: To minimise structural damage and compaction of the soils and to aid restoration of the site.

Topsoils and subsoils shall be handled separately and where necessary stored separately in bunds until they are required for restoration. Reason: To ensure restoration of a high quality can be achieved.

All soil storage bunds shall be sown with a suitable grass seed mix during the first available sowing season following their construction and shall be maintained whilst in place to prevent weed growth unless otherwise agreed in writing by the Mineral Planning Authority. Reason: To minimise visual intrusion and adverse effects on the soil structure.

The existing trees/shrubs/bushes identified on approved plans numbered 97033/BF/3a, 970033/BF/3b, 97033/BF/3c and 97033/BF/6a shall be retained for the duration of development and shall not be damaged, destroyed, uprooted, felled, lopped or topped for the duration of development unless otherwise agreed in writing by the Mineral Planning Authority. Any such trees/shrubs/bushes removed without permission or dying or being seriously damaged or diseased during that period shall be replaced in the following planting season with plants of size and species as agreed in writing by the Mineral Planning Authority. Reason: In the interests of visual amenity.

No operations nor stockpiling shall take place within a distance of twice the radius of the crown spread of any tree from its trunk and within 5 metres of any hedgerow required to be retained by condition 18. Reason: To protect the health and stability of the trees and hedgerows to be retained on site.

The planting shown on approved drawing number 97033/BF/6a shall be carried out in the planting season (November to February) coinciding with or immediately following restoration, whichever is the sooner, unless otherwise agreed by the Mineral Planning Authority in writing. Reason: In accordance with Section 197 of the Town and Country Planning Act 1990 and in the interests of visual amenity.

Any trees/shrubs planted as part of the landscaping scheme which within a period of five years from the date of planting are removed or become seriously damaged or diseased or die shall be replaced in the next planting season with others of similar size and species unless otherwise agreed by the Mineral Planning Authority. Reason: To ensure as far as possible the maintenance of the approved landscaping and in the interests of visual amenity.

Within six months of the date of this permission or such other date as agreed by the Mineral Planning Authority in writing, a written aftercare scheme for all the land outlined in orange on approved plan number 97033/BF/1a shall be submitted for the written approval of the Mineral Planning Authority. The submitted scheme shall specify the steps as may be necessary to bring the identified land to the required standard for nature conservation and angling and the time when each step is to be implemented. Provision shall also be made for an annual site meeting to discuss the detailed steps necessary on the restored land. Reason: To bring the site and adjoining blue land to the required standard for angling and nature conservation and to ensure a high level of restoration is sustained.

No later than two weeks following the annual meeting which shall take place during February or March each year a detailed scheme for the aftercare of the restored land shall be submitted for written approval by the Mineral Planning Authority. Reason: To ensure a high level of restoration is sustained.

Aftercare of the site and adjoining blue land shall take place for a period of five years and in accordance with the schemes approved under conditions 22 and 23 beginning when restoration is completed in accordance with the approved scheme. Reason: To ensure a high level of restoration is sustained.

Materials to be used in restoration of the site shall be wholly inert, uncontaminated materials generated from the site. Reason: In order to prevent pollution of the water environment.

Tanks containing fuel, oil or chemicals shall not be located at the site other than on an impervious base surrounded by liquid tight bund walls capable of retaining at least 110 per cent of the tank(s) volume and any spillages from fill or draw pipes. No drainage outlet shall be provided. Any fill pipes, draw pipes and sight gauges shall be enclosed within the bunded area and the vent pipe directed downwards into the bund. Reason: To prevent pollution of the water environment.
