Conditions / Refusal Reasons
That the development shall be carried out strictly in accordance with the conditions attached to outline planning permission P99/S0061/O (copy attached) and subject to the conditions hereby imposed. Reason: To secure the proper planning of the locality.

That the development must be begun not later than the expiration of two years beginning with the date of this permission, and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.

That no development shall take place until there has been submitted to and approved in writing by the Local Planning Authority a scheme of landscaping which shall include details of all existing trees and hedgerows on the land and details of those to be retained, together with measures for their protection during the course of the development. The scheme shall also include details of the surface treatment of the roads, driveways and hardstandings and all walls, fences and gates and external lighting. Thereafter the surfacing, enclosures and lighting installed shall be retained in accordance with the approved details unless otherwise agreed in writing. Reason: To help assimilate the development into its surroundings and to accord with policy G9 of the Council's adopted South Oxfordshire Local Plan.

That all planting, seeding or turfing comprised in the approved scheme of landscaping shall be carried out in the first planting and seeding seasons following the occupation of the buildings or the completion of the development, whichever is the sooner; and any trees or plants which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation. Reason: To help to assimilate the development into its surroundings and to accord with policy G9 of the Council's adopted South Oxfordshire Local Plan.

That no dwelling shall be occupied until the roads, driveways, hardstandings, fences, walls and gates serving that dwelling have been fully provided in accordance with the details approved pursuant to condition 3 above. Reason: To help assimilate the development into its surroundings and to accord with policy G9 of the Council's adopted South Oxfordshire Local Plan.

That the buildings be constructed and finished in accordance with a schedule of materials and finishes which shall first have been submitted to and approved in writing by the Local Planning Authority before the development commences. Reason: To ensure that the details of the development are satisfactory and to accord with policy H11 of the Council's adopted South Oxfordshire Local Plan.

That notwithstanding the provisions of Article 3 of, and Class A of Part 1 of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order), no development within Classes A, B and C of Part 1 of Schedule 2 to the Order shall be carried out on the land unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof. Reason: To protect local amenities and to accord with policy H11 of the Council's adopted South Oxfordshire Local Plan.

That the garage accommodation shall be retained as such and shall not be adapted for living purposes unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof. Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities and to comply with policy G11 of the Council's adopted South Oxfordshire Local Plan.

No soakaways shall be constructed such that they penetrate the water table, and they shall not in any event exceed 2 metres in depth below existing ground level. Reason: To avoid pollution and in the interests of public health and to comply with policy G17 of the Council's adopted South Oxfordshire Local Plan.

That unless otherwise agreed in writing with the Local Planning Authority all trees and hedges on the land shall be retained for a period of 5 years following the completion of the development and, together with trees and hedges on, or near, the boundaries of the land be protected in accordance with BS 5837 during the course of demolition and construction works. Any tree or hedge plant which within that period die, are removed, or become seriously damaged or diseased, shall be replaced in the next planting season with others of a similar size and species, unless the Local Planning Authority gives written consent to any variation. Reason: To protect trees and hedges which are of importance in accordance with policy C16 of the Council's adopted South Oxfordshire Local Plan.

That prior to the commencement of the development details of the slab levels of all the buildings shall be submitted to and be approved in writing by the Local Planning Authority. The development shall thereafter be constructed only in accordance with the approved details. Reason: To ensure that the development is not unneighbourly and to accord with policy G8 of the Council's adopted South Oxfordshire Local Plan.

That notwithstanding anything contained in the Town and Country Planning (General Permitted Development) Order 1995 (or an order revoking or re-enacting that Order) no additional first floor windows or rooflights shall be constructed in the dwellings or garages. Reason: To ensure that the development is not unneighbourly and to accord with policy H11 of the Council's adopted South Oxfordshire Local Plan.

That all first floor bathroom windows shall be glazed in obscured glass prior to the first occupation of each dwelling. Reason: To ensure that the development is not unneighbourly and to accord with policy H11 of the Council's adopted South Oxfordshire Local Plan.
