Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.
That those buildings/structures shown to be demolished on drawing no. 9872-PO1 accompanying the application shall be demolished and the materials therefrom removed from the land prior to the commencement of any other development.
Reason: The demolition of these structures would result in an enhancement to the character
of the Chilterns Area of Outstanding Natural Beauty and the setting of the buildings
in accordance with policies C2 and C11 of the Council's adopted South Oxfordshire
Local Plan.
That notwithstanding any indications as to these matters which may have been given in the application, no development shall take place until there has been submitted to and approved in writing by the Local Planning Authority a schedule of materials and finishes for the buildings.
Reason: To ensure that the details of the development are satisfactory and to accord with
policies G8, C2 and C11 of the Council's adopted South Oxfordshire Local Plan.
That development shall not begin until a detailed specification of the type, design and external finish of all windows, external doors and means of ventilation has been submitted to and approved in writing by the Local Planning Authority.
Reason: To ensure that the details of the development are satisfactory and to accord with
policies G8, C2 and C11 of the Council's adopted South Oxfordshire Local Plan.
That no development shall take place until there has been submitted to and approved in writing by the Local Planning Authority a scheme of landscaping which shall include indications of all existing trees and hedgerows on the land, and details of any to be retained, together with measures for their protection in the course of development.
Reason: To protect local amenities and to accord with policy G9 of the Council's adopted
South Oxfordshire Local Plan.
That all planting, seeding or turfing comprised in the approved scheme of landscaping shall be carried out in the first planting and seeding seasons following the occupation of the buildings or the completion of the development, whichever is the sooner; and any trees or plants which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation.
Reason: To help to assimilate the development into its surroundings and to accord with
policy G9 of the Council's adopted South Oxfordshire Local Plan.
That the proposed windows in the north elevation and the existing windows in the east elevation shall be installed or modified to ensure that they have a minimum finished floor level to cill height of not less than 1.8 metres and shall be retained as such thereafter.
Reason: To ensure that development is not unneighbourly and to accord with policy C11 of
the Council's adopted South Oxfordshire Local Plan.
That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order) no windows or rooflights shall be constructed in the north, east and south elevations of the building other than those expressly authorised by this permission.
Reason: To ensure that the development is not unneighbourly and to accord with
policy C11 of the Council's adopted South Oxfordshire Local Plan.
That notwithstanding the provisions of Article 3 of, and Classes A-H of Part 1 of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order), no development within Classes A-H of Part 1 of Schedule 2 to the Order shall be carried out on the land unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof.
Reason: To protect local amenities and to accord with policy C11 of the Council's adopted
South Oxfordshire Local Plan.
That the residential curtilage of the extended dwelling shall be restricted to the area edged red on the attached plan.
Reason: Extension of the residential curtilage beyond this area would result in an
inappropriate intrusion into the countryside and would detract from the rural
character and amenity of the Chilterns Area of Outstanding Natural Beauty,
contrary to policy C2 of the Council's adopted South Oxfordshire Local Plan.
That details of any external lighting shall be submitted to and approved in writing by the Local Planning Authority prior to its installation and the lighting shall only be installed in accordance with the approved details.
Reason: To protect local amenities in accordance with policy C2 of the Council's adopted
South Oxfordshire Local Plan.
