Description
Construction of pair of 3 bedroom houses together with extension to and widening of existing access track/road (as amplified by drawing nos.7244-00-01a, 01B, 02 and 03 accompanying letter from Agent dated 15 December 2000 and amended by certificate of ownership accompanying letter from agent dated 4 September 2001).
Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.
That no development shall take place until there has been submitted to and approved in writing by the Local Planning Authority a schedule of all external materials and finishes for the buildings.
Reason: To ensure that the details of the development are satisfactory and to accord with
policies G8, H4 and H11 of the Council's adopted South Oxfordshire Local Plan.
That prior to the commencement of any other development to which this permission relates, the means of access between the land and the highway shall be formed, laid out and constructed strictly in accordance with the specification of the means of access attached hereto, and all ancillary works therein specified shall be undertaken strictly in accordance with the said specification.
Reason: To provide a safe and convenient access to the development in accordance with
policies G10, H4 and H11 of the Council's adopted South Oxfordshire Local Plan.
That no dwelling shall be occupied until the parking and turning areas have been provided in accordance with drawing no. 7244-00-01b accompanying the application and these areas shall thereafter be retained for the parking and turning of vehicles.
Reason: To provide adequate parking and turning facilities in accordance with policies G10,
H4 and H11 of the Council's adopted South Oxfordshire Local Plan.
That, prior to the commencement of the development a report of an investigation to establish the nature and content of any contamination of the site by methane gas shall be submitted to and approved in writing by the Local Planning Authority. The report shall identify the remedial measures required and shall be carried out in accordance with guidelines obtained from the waste disposal authority.
Reason: In the interests of public health and safety in accordance with Policy G7 of the
Council's adopted South Oxfordshire Local Plan.
That any remedial measures identified in condition 5 above shall be carried in accordance with the detailed report prior to the first occupation of either of the dwellings.

Council's adopted South Oxfordshire Local Plan.
That no development shall take place until there has been submitted to and approved in writing by the Local Planning Authority a scheme of landscaping, which shall be based on an accurate tree survey, and which shall include details of how existing trees on the land, especially the silver birch trees, are to be retained, together with measures for their protection during the course of development. Thereafter the trees shall be protected in accordance with approved details prior to the commencement of any work.
Reason: To protect local amenities in accordance with policies G9 and C16 of the Council's
adopted South Oxfordshire Local Plan.
That all planting, seeding or turfing comprised in the approved scheme of landscaping shall be carried out in the first planting and seeding seasons following the occupation of the buildings or the completion of the development, whichever is the sooner; and any trees or plants which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation.
Reason: To help to assimilate the development into its surroundings.
That no development shall commence until detailed plans of the existing and proposed ground levels, slab levels of the proposed dwellings and details of the retaining walls, including cross sections have been submitted to and approved in writing by the Local Planning Authority. Thereafter the development shall only be carried out strictly in accordance with the approved details.
Reason: As no such details are contained in the application and the height of the buildings
and land will affect the impact of the development on the amenities of the area in
accordance with policies H4, G8 and G9 of the South Oxfordshire Local Plan.
That no development shall commence until there has been submitted to and approved in writing by the Local Planning Authority a scheme for the protection of the public footpath during the construction of the dwellings and the development shall be carried out strictly in accordance with the approved scheme.
Reason: To protect the public footpath which runs through the site in accordance with
policy R7 of the Council's adopted South Oxfordshire Local Plan.
That notwithstanding the provisions of Article 3 of, and Classes A, B and C of Part 1 of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order), no development within Classes A, B, C and E of Part 1 of Schedule 2 to the Order shall be carried out on the land unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof.
Reason: In view of the restricted size of the site and its proximity to the public footpath any
further development would detract from the character and appearance of the area in
accordance with Policy H4 of the Council's adopted South Oxfordshire Local Plan.
