Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.
That notwithstanding any indications as to those matters which may have been given in the application, no development shall take place until there has been submitted to and approved in writing by the Local Planning Authority a schedule of materials and finishes for the external walls and roofs of the buildings.
Reason: To ensure that the details of the development are satisfactory and to accord with
policies H5 and G8 of the Council's adopted South Oxfordshire Local Plan.
That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order) no windows or rooflights shall be constructed in the south (rear) and west (side) elevations of the building other than those expressly authorised by this permission.
Reason: To ensure that the development is not unneighbourly and to accord with policy H5
of the Council's adopted South Oxfordshire Local Plan.
That no development shall commence until all existing buildings within the site have been demolished and the materials therefrom removed from the land.
Reason: To safeguard the character of the area and to accord with policy H5
of the Council's adopted South Oxfordshire Local Plan.
That notwithstanding the provisions of Article 3 of, and Classes A and C of Part 1 of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order), no development within Classes A and C of Part 1 of Schedule 2 to the Order shall be carried out on the land unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof.
Reason: To protect local amenities and to accord with policy H5 of the Council's adopted
South Oxfordshire Local Plan.
That prior to the commencement of any development, including site clearance, all trees, shrubs and hedges on the site shall be protected in accordance with a scheme which shall comply with BS5837. Such scheme shall first have been submitted to and approved in writing by the Local Planning Authority. Should any works be necessary within the protection zone (eg patio construction) prior notice should be given to the Local Planning Authority, with a method statement showing how the works will be implemented whilst minimising impact to the trees. The works shall thereafter only be carried out in accordance with the method statement agreed by the Local Planning Authority.
Reason: To safeguard the trees and hedges which are visually important and to accord with
policy G10 of the Council's adopted South Oxfordshire Local Plan.
That, prior to the commencement of the development, details of the slab levels of the buildings shall be submitted to and approved in writing by the Local Planning Authority and thereafter the development shall only be carried out in accordance with the approved details.
Reason: To ensure that the new buildings are not prominent in the street scene or
unneighbourly and to comply with policy H5 of the Council's adopted South
Oxfordshire Local Plan.
That prior to the commencement of any other development to which this permission relates, the means of access between the land and the highway shall be formed, laid out and constructed strictly in accordance with the specification of the means of access attached hereto, and all ancillary works therein specified shall be undertaken strictly in accordance with the said specification.
Reason: In the interests of highway safety and convenience and to accord with policy G10
of the Council's adopted South Oxfordshire Local Plan.
That the new dwelling shall not be occupied until the parking provision has been constructed, surfaced and laid out, as shown on drawing no. 1512 1A; and such parking provision shall be retained thereafter.
Reason: To comply with the Local Planning Authority's vehicle parking standards and to
protect local amenities and to accord with policy G8 of the Council's adopted South
Oxfordshire Local Plan.
That the rooflights in the southern elevation of the building shall be obscure glazed prior to the first occupation of the dwelling and shall be retained as such thereafter.
Reason: To ensure that the development is not unneighbourly and to accord with policy H5
of the Council's adopted South Oxfordshire Local Plan.
