Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.
That the external walls and roofs be constructed and finished in accordance with a schedule of materials and finishes which shall first have been submitted to and approved in writing by the Local Planning Authority before the development commences.
Reason: To ensure that the details of the development are satisfactory in accordance with
Policies G1 and G8 of the adopted South Oxfordshire Local Plan.
That the units hereby permitted shall only be used for purposes falling within Use Class B1(c) and B8 of the Town and Country Planning (Use Classes) Order 1987 or in any provision equivalent to those Classes in any statutory instrument revoking and re-enacting that Order.
Reason: That the site has limited car parking provision and that permission has been granted
in the light of an extant consent. A B1(a) or B1(b) use is likely to generate a
higher demand for car parking space which cannot be provided for on this site, in
accordance with Policy G11 of the adopted South Oxfordshire Local Plan.
That, prior to the commencement of any development a detailed site investigation shall be carried out to establish if the site is contaminated, to assess the degree and nature of the contamination present and to determine its potential for the pollution of the water environment. The method and extent of this site investigation shall have previously been agreed in writing by the Local Planning Authority together with details of appropriate measures to prevent pollution of ground water and surface water including provision for the monitoring. The development shall thereafter proceed only in accordance with measures approved.
Reason: To prevent the pollution of the water environment in accordance with Policies G7
and G8 of the Council's adopted South Oxfordshire Local Plan.
That no machinery shall be operated, processes carried out or deliveries taken or dispatched outside the hours of 7.30am to 6.30pm Mondays to Fridays and 7.30am to 1.00pm on Saturdays.
Reason: To protect the amenity of neighbouring residents in accordance with Policies G6
and G7 of the adopted South Oxfordshire Local Plan.
That no additional doors, windows or rooflights shall be installed in the elevations or roofslopes of the units hereby permitted.
Reason: To protect the amenity of neighbouring residents in accordance with Policy E6 of
the adopted South Oxfordshire Local Plan.
That surface water and foul water shall not be disposed of other than in accordance with a detailed surface water and foul water drainage scheme which shall first have been submitted to and approved in writing by the Local Planning Authority.
Reason: In the interests of public health in accordance with Policies G6 and G17 of the
adopted South Oxfordshire Local Plan.
That prior to the commencement of any other development to which this permission relates the means of access between the land and the highway shall be formed, laid out and constructed strictly in accordance with the deposited plan reference 1522/03A and the attached specification and all ancillary works therein specified shall be undertaken strictly in accordance with the said specification and deposited plan.
Reason: In the interests of highway safety and convenience in accordance with Policies E6
and G10 of the Council's adopted South Oxfordshire Local Plan.
That the units shall not be occupied until the parking provision has been constructed, surfaced and laid out, as shown on drawing no. 1522/03A; and such parking provision shall be retained thereafter and not used for any other purpose.
Reason: To comply with the Local Planning Authority's car parking standards in accordance
with Policy G11 of the Council's adopted South Oxfordshire Local Plan.
That a scheme for the landscaping of the site and the provision of boundary fencing and screen walling, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme to the complete satisfaction of the Local Planning Authority. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 3 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority.
Reason: To help assimilate new development into its surroundings in accordance with
Policies G8 and E6 of the Council's adopted South Oxfordshire Local Plan.
