Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five
years beginning with the date of this permission and if this condition
is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning
Act 1990.
That no development shall take place until there has been submitted to
and approved in writing by the Local Planning Authority a schedule
of materials and finishes for the bridge, ramp and associated fencing.
Reason: To ensure that the details of the development are satisfactory.
That no development shall take place until there has been submitted to
and approved in writing by the Local Planning Authority a scheme of
landscaping which shall include indications of all existing trees and
hedgerows on the land, and details of any to be retained, together with
measures for their protection in the course of development.
Reason: To protect local amenities and reduce the effect of the development
on neighbouring properties.
That all planting, seeding or turfing comprised in the approved scheme of
landscaping shall be carried out in the first planting and seeding seasons
following the opening of the bridge to the public or the completion
of the development, whichever is the sooner; and any trees or plants which
within a period of 5 years from the completion of the development die,
are removed or become seriously damaged or diseased shall be replaced
in the next planting season with others of similar size and species,
unless the Local Planning Authority gives written consent to any
variation.
Reason: To help to assimilate the development into its surroundings and
reduce its impact on neighbouring properties.
That existing ground levels on the site shall not be raised.
Reason: To prevent the increased risk of flooding due to impedance of
flood flows and reduction of flood storage capacity.
That no spoil or materials shall be deposited or stored on that part of
the site lying within the area of land liable to flood as shown on maps
held by the Environment Agency.
Reason: To prevent the increased risk of flooding due to impedance of

That no development shall commence until measures to prevent parking
under the viaduct in Mill Lane have been carried out and completed
in accordance with a scheme which shall first have been submitted
to and approved in writing by the Local Planning Authority.

and convenience of users of Mill Lane.
That, prior to the opening of the bridge to the public, measures to
prevent motorbikes, mopeds and other vehicles powered by an internal
combustion engine from using the bridge and ramp shall have been
carried out and completed in accordance with a scheme which shall
first have been submitted to and approved in writing by the Local
Planning Authority; and such measures shall be retained thereafter.
Reason: To protect local amenities and to secure the safety and
convenience of users of the foot/cycle and disabled access
bridge and ramp.
