Variation of conditions 2 (Approval of drawings) and condition 3 (Approval of materials) on applications P18/S3750/FUL and P19/S3211/FUL for design of house changed and choice of materials changed.
(Description from P19/S3211 - Variation of conditions 2 and 11 of P18/S3750/FUL to allow for the barns to be demolished, a phased approach to implementation to comprise of: Phase 1: Demolition of two buildings and site clearance. Phase 2: erection of a single residential dwelling, garage and associated works, and the enlargement of the garage.)
Conditions / Refusal Reasons
Condition 1 required development to commence within 3 years of the date of the original permission. Development has commenced and this condition is no longer necessary, it is included to preserve the original numbering for other conditions.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, PL001A, PL002A, PL003, PL004, PL005, PL006, PL007, PL008, 4366-Building-Ex and 4377-Building2, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The exterior of the development hereby permitted shall only be constructed in the materials specified on the plans hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policy DES1 and DES2 South Oxfordshire Local Plan 2035.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order), the enlargement of any dwellinghouse as described in Schedule 2, Part 1, Class A of the Order shall not be undertaken without obtaining planning permission for the Local Planning Authority.
Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of the openness of the Oxford Green Belt in accordance with Policy STRAT6 of the South Oxfordshire Local Plan 2035.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order) the provision within the curtilage of the dwelling of any building, enclosure or swimming pool as described in Schedule 2, Part 1, Class E of the Order shall not be undertaken without obtaining planning permission for the Local Planning Authority.
Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of the openness of the Oxford Green Belt in accordance with Policy STRAT6 of the South Oxfordshire Local Plan 2035.
That all existing buildings on the site shall be demolished before the new development hereby permitted is first occupied, and any demolished material which is not to be utilised in the new development shall be removed from the land, unless an alternative scheme for the phased demolition of the building(s) and removal of materials is first submitted to and approved in writing by the Local Planning Authority.
Reason: In the interests of the openness of the Oxford Green Belt in accordance with Policy STRAT6 of the South Oxfordshire Local Plan 2035.
Prior to occupation of the dwelling hereby permitted the proposed means of access onto Brook Lane is to be formed and laid out and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken.
Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Prior to the first occupation of the development vision splays measuring 2.4 metres by 25 metres shall be provided to each side of the access and the vision splays shall not be obstructed by any object, structure, planting or other material with a height exceeding or growing above 0.9 metres as measured from carriageway level.
Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Prior to the first occupation of the development, hereby approved, the parking and turning areas shall be provided in accordance with drawing no. PL002A, and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interests of highway safety and in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
The garage accommodation hereby approved shall be retained as such and shall not be adapted for living purposes without planning permission from the Local Planning Authority.
Reason: In the interests of highway safety and to ensure the provision of adequate off-street car parking in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
With the exception of demolition works, the development hereby permitted shall not be commenced until details of surface water drainage have been submitted to and approved in writing by the Local Planning Authority. Thereafter, the development shall proceed in accordance with the approved details and the surface water drainage shall be operational prior to occupation of the dwelling.
Reason: To prevent pollution and flooding in accordance with Policies EP4 and INF4 of the South Oxfordshire Local Plan 2035.
With the exception of demolition works, the development hereby permitted shall not be commenced until details of foul drainage have been submitted to and approved in writing by the Local Planning Authority. Thereafter, the development shall proceed in accordance with the approved details and the drainage shall be operational prior to occupation of the dwelling.
Reason: To prevent pollution in accordance with Policies EP4 and INF4 of the South Oxfordshire Local Plan 2035.
With the exception of demolition works and following the findings of the Phase 1 Desk Study Report Reference : LP01996, prior to the commencement of any other development a phased risk assessment shall be carried out by a competent person in accordance with current government and Environment Agency Guidance and Approved Codes of Practice. Each phase shall be submitted to and approved in writing by the Local Planning Authority.
Phase 2 shall include a comprehensive intrusive investigation in order to characterise the type, nature and extent of contamination present, the risks to receptors and if significant contamination is identified to inform the remediation strategy.
Phase 3 requires that a remediation strategy be submitted to and approved by the LPA to ensure the site will be rendered suitable for its proposed use.
Reason: To ensure that any ground, water and associated gas contamination is identified and adequately addressed to ensure the safety of the development, the environment and to ensure the site is suitable for the proposed use in accordance with Policy ENV12 of the South Oxfordshire Local Plan 2035.
The development shall not be occupied until any previously approved remediation strategy has been carried out in full and a validation report confirming completion of these works has been submitted to and approved in writing by the Local Planning Authority.
Reason: To ensure that any ground, water and associated gas contamination is identified and adequately addressed to ensure the safety of the development, the environment and to ensure the site is suitable for the proposed use in accordance with Policy ENV12 of the South Oxfordshire Local Plan 2035.
That the development hereby approved shall, unless otherwise agreed in writing beforehand with the Local Planning Authority, be carried out in two phases. Phase 1 shall comprise the demolition of existing structures and site clearance and Phase 2 shall consist of the construction of the dwelling and garage hereby approved.
Reason: To ensure that any ground, water and associated gas contamination is identified and adequately addressed to ensure the safety of the development, the environment and to ensure the site is suitable for the proposed use in accordance with Policy ENV12 of the South Oxfordshire Local Plan 2035.
