Conditions / Refusal Reasons
No development shall take place until permission for the associated solar farm has been granted permission (Ref: P21/S3915/FUL) or subsequent variation permitted through S73 or S96 of the Town and Country Planning Act 1990). Reason: The proposed cable works are required only in connection with the solar farm.

The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans: Cable Route Layout sheet 1.0 v3 Cable Route Layout sheet 1.1 v3 Cable Route Layout sheet 1.2 v3 Cable Route Layout sheet 1.3 v3 Cable Route Location Plan sheet 1.0 v3 Cable Route Location Plan sheet 1.1 v3 Cable Route Location Plan sheet 1.2 v3 Cable Route Location Plan sheet 1.3 v3 HV Trench Detail sheet 1.0 except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

Prior to the commencement of any site works (including demolition or site clearance) a phased area for protection of trees shall be designated for all existing trees which are shown to be retained, and the trees shall be protected in accordance with a scheme which complies with the current edition of BS 5837 which in this case is the protection measures set out in Barton Hyett Associates - Combined AIA & AMS, Dodwells Solar Farm, Ref:5320 Dated:07/12/2022. The agreed measures shall be kept in place during the entire course of development. Reason: To safeguard trees which are visually important in accordance with Policies ENV1, DES1, and DES2 of the South Oxfordshire Local Plan 2035.

The proposed development shall be undertaken wholly within the metalled road surface where it is within highway land. No development works, construction, engineering operations or works shall take place beyond the limits of the metalled road surface and shall be undertaken along the road shown on plans. Works outside of the highway land will be controlled by other conditions attached to this planning permission. To ensure the protection of biodiversity, wildlife, trees and the countryside in accordance with Policy ENV1 (Landscape and Countryside), Policy ENV2 (Biodiversity - Sites, Habitats and Species), and Policy ENV3 (Biodiversity).

No construction work is to commence until a scheme showing watercourse crossing proposals has been submitted to and approved by the local planning authority. This scheme shall be based on the information in report WW-SSE-OPDE004 revision 1.1 by Walker and Watts Ltd and shall include a suitable Contractors Method Statement with suitable mitigation measures to protect all ditches and watercourses along the route. No cables, ducts or other infrastructure associated with this application are to be located within or run through watercourses, ditches, culverts, pipes or other surface water or watercourse conduit, or be hung from the underside of bridges or in a location that could cause watercourse or surface water drainage blockage or increase the risk of flooding. There shall be no filling in or reducing of cross-sectional area of watercourses or ditches as a result of placing infrastructure and all works shall be undertaken in accordance with the method statement to be approved. The report shall include measures to ensure the structural integrity and protection of any buildings, bridges and structures in the vicinity to construction including engineers report from a structural engineer. Reason: To ensure the protection of watercourses, to avoid increasing flood risk elsewhere and to avoid damage nearby buildings, structures and bridges in accordance with Policy ENV4, Policy EP4, Policy ENV6, Policy ENV7 and Policy ENV8.

Prior to the commencement of the development (including vegetation clearance), a Construction Environmental Management Plan for Biodiversity (CEMP: Biodiversity) shall be submitted to and approved in writing by the Local Planning Authority. The CEMP (Biodiversity) shall be based on Chapter 4 of the submitted Environmental Statement and associated Ecology Appendices and Figures prepared by Pegasus Group dated August 2021. It shall include the following: a) Update ecological surveys for relevant habitats and species, update surveys shall follow national good practice guidelines. b) Risk assessment of potentially damaging construction activities. c) Identification of biodiversity protection zones. d) Practical measures (both physical measures and sensitive working practices) to avoid, reduce or mitigate the impacts on important habitats and protected species during construction. e) The location and timing of sensitive works to avoid harm to biodiversity features. f) The times during construction when specialist ecologists need to be present on site to oversee works. g) Responsible persons and lines of communication. h) Use of protective fences, exclusion barriers and warning signs. I) Details of the methods to be used to reinstate vegetation or mitigate impacts should it be damaged or lost. The approved CEMP (Biodiversity) shall be adhered to and implemented throughout the construction period strictly in accordance with the approved details. Reason: To minimise the impacts of development on biodiversity, in accordance with Policies ENV1, ENV2 and ENV3 of the South Oxfordshire Local Plan 2035.

No development shall commence on site (including any works of demolition), until a phased Construction Method Statement, which shall include the following: a) the parking of vehicles of site operatives and visitors; b) loading and unloading of plant and materials; c) storage of plant and materials used in constructing the development; d) the erection and maintenance of security hoarding e) on site wheel washing facilities; f) measures to control the emission of dust and dirt during construction. including wheel washing; g) a scheme for recycling/disposing of waste resulting from construction works; h) measures for the protection of the natural environment; i) hours of construction, including deliveries; j) construction traffic management, routing and traffic light arrangements; k) restoration of the road surface and any damage to verges; l) management of flood risk and drainage, particularly in the vicinity of watercourse crossings and flood risk areas. has been submitted to, and approved in writing by, the Local Planning Authority. The approved Statement shall be adhered to throughout the construction period. The development shall not be carried out otherwise than in accordance with the approved construction methods. Reason: To ensure that the development is not unneighbourly in accordance with Policy DES6 of the South Oxfordshire Local Plan 2035. To ensure the proposal does not result in detrimental impacts to the highway network in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

Prior to any demolition and the commencement of the development a professional archaeological organisation acceptable to the Local Planning Authority shall prepare an Archaeological Written Scheme of Investigation, relating to the application site area, which shall be submitted to and approved in writing by the Local Planning Authority. Reason: To enable an appropriate level of archaeological investigation of the area including excavation and recording, post excavation analysis and the publication of results in accordance with Policy ENV9 South Oxfordshire Local Plan 2035 and the National Planning Policy Framework.

Following the approval of the Written Scheme of Investigation, and prior to the commencement of the development (other than in accordance with the agreed Written Scheme of Investigation), a programme of archaeological investigation and mitigation, including provision for the preservation of any significant archaeological remains, shall be carried out by the commissioned archaeological organisation in accordance with the approved Written Scheme of Investigation. The programme of work shall include all processing, research and analysis necessary to produce an accessible and useable archive and a full report for publication which shall be submitted to the Local Planning Authority within two years of the completion of the archaeological fieldwork. Reason: To enable an appropriate level of archaeological investigation of the area including excavation and recording, post excavation analysis and the to safeguard the identification, recording, preservation, analysis and archiving of heritage assets before they are lost and to advance understanding of the heritage assets in their wider context through publication and dissemination of the evidence in accordance with Policy ENV9 of the of the South Oxfordshire Local Plan 2035 and National Planning Policy Framework.
