Demolition of existing bungalow and garage and erection of new chalet style house (As amended by revised plans amended plans, arboricultural impact assessment, preliminary bat roost assessment, energy statement, and water efficiency calculator received 17/05/2021 and bat survey received 31/08/2021).
Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
The development hereby approved shall be carried out in accordance with the details shown on the following approved plans except as controlled or modified by conditions of this permission:
- Existing details and location plan - drawing no. MAN/02/21
- Proposed plans sections and elevations - drawing no. MAN/01/21/A
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
No development shall commence until a single bat box (such as the Schwegler 2F) has been erected on site in a position and orientation informed by a suitably qualified ecologist. Once erected the bat box should be retained as such thereafter.
Reason: To provide biodiversity enhancements on site, in accordance with Policies ENV2 and ENV3 of the SOLP, and paragraphs 174 and 180 of the NPPF.
Prior to the commencement of any site works (including demolition or site clearance) a tree protection scheme which complies with the current edition of BS 5837, 2012 : Trees in Relation to Design, Demolition and Construction shall be submitted to and approved in writing by the local planning authority. The tree protection scheme shall be designated for all existing trees which are shown to be retained. The agreed measures shall be kept in place during the entire course of development.
Reason: To safeguard trees which are visually important in accordance with Policies ENV1, DES1, and DES2 of the South Oxfordshire Local Plan 2035.
Prior to the commencement of development, a full surface water drainage scheme, including details of the size, position and construction of drainage works, shall be submitted to, and approved in writing by, the Local Planning Authority. The drainage scheme shall be designed to accommodate a 1 in 100 year storm + 40% CC and shall be implemented in accordance with the approved details prior to the occupation of the development hereby approved.
Reason: To ensure the proper provision of surface water drainage and to ensure flooding is not exacerbated in the locality in accordance with Policy EP4 of the South Oxfordshire Local Plan 2035.
The dwelling shall not be occupied until the existing access onto Latchford Lane has been improved, laid out and constructed in accordance with the local highway authority's specifications.
Reason: In the interest of highway safety in accordance with policy TRANS5 of the South Oxfordshire Local Plan 2035.
The dwelling shall not be occupied until the parking and turning areas have been provided in accordance with drawing no. MAN/01/21/A. The parking and turning areas shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interests of highway safety and in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Prior to first occupation of the dwelling house, all carbon reduction energy efficiency measures shall be implemented in accordance with the energy statement produced by Energist and SAP calculations produced by E & S Bristol Limited (ref: Manana) hereby approved and a verification report shall be submitted to the local planning authority and approved in writing. The verification report shall demonstrate (with photographic evidence) that the energy efficiency measures have been implemented. These measures shall be retained and maintained as such thereafter in accordance with the energy statement and verification report.
Reason: To ensure high standards of sustainable design and construction in accordance with Policy DES10 of the South Oxfordshire Local Plan 2035.
The dwelling shall not be occupied until an Electric Vehicle Charging Point has been installed.
Reason: To ensure sustainable forms of transport are provided in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
The development hereby approved shall be implemented in accordance with sections 4.3 and 5.2 of the supporting Bat Survey Report (GS Ecology, Ref: ECO2803b).
Reason: To minimise the ecological impacts of development, in accordance with Policy ENV2 of the SOLP and paragraphs 174 and 180 of the NPPF.
The hours of operation for construction and demolition works shall be restricted to 08:00-18:00 Monday to Friday and 08:00-13:00 on a Saturday. No work is permitted to take place on Sundays or Public Holidays without the prior written authority of the Local Planning Authority.
Reason: To ensure that the development is not unneighbourly in accordance with Policy DES6 of the South Oxfordshire Local Plan 2035.
The development hereby permitted shall only be constructed in the materials specified on the plans hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with policies DES1 and DES2 of the South Oxfordshire Local Plan 2035.
Notwithstanding the provisions of Classes A, B, C, and D of Part 1 Schedule 2 of the Town and Country Planning (General Permitted Development) Order 2015 (or the equivalent provisions of any order revoking and re-enacting that Order), there shall be no extension or roof alteration to the dwelling hereby permitted without the prior grant of planning permission.
Reason: To safeguard the amenities of the occupiers of the adjoining properties and the character of the area in accordance with Policies DES1, DES2 and DES6 of the South Oxfordshire Local Plan 2035.
