Conditions / Refusal Reasons
That the development to which this permission relates shall be begun not later than whichever is the later of the following dates: (a) the expiration of three years from the date of this permission; or (b) the expiration of two years from the final approval of the reserved matters, or in the case of approval on different dates, the final approval of the last such matter to be approved. Reason: By virtue of Section 91 to 95 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.

Approval of the details of the layout, scale, appearance, the means of access thereto and the landscaping of the site (hereinafter called "the reserved matters") shall be obtained from the Local Planning Authority in writing before any development is commenced. Reason: As the application is in outline only and is not accompanied by detailed plans and by virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.

In the case of any reserved matter, application for approval must be made not later than the expiration of three years from the date of this outline planning permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.

The total number of dwellings to be constructed on the site shall not exceed two. Reason: To protect local amenities in accordance with Policies ENV1, DES1 and STRAT1 of the South Oxfordshire Local Plan 2035.

That all existing buildings on the site shall be demolished before the new development hereby permitted commences, and any demolished material which is not to be utilised in the new development shall be removed from the land, unless an alternative scheme for the phased demolition of the buildings and removal of materials is first submitted to and approved in writing by the Local Planning Authority. Reason: To ensure satisfactory comprehensive development in accordance with Policies STRAT1, DES1, DES2 and DES7 of the South Oxfordshire Local Plan 2035.

Prior to the commencement of development detailed plans showing the existing and proposed ground levels of the site together with the slab and ridge levels of the proposed development, relative to a fixed datum point on adjoining land outside of the application site, shall be submitted to and approved in writing by the Local Planning Authority. Thereafter the development shall be carried out in accordance with the approved details. Reason: To ensure a satisfactory form of development in accordance with Policies STRAT1, DES1, DES2 and ENV1 of the South Oxfordshire Local Plan 2035.

Prior to the commencement of development, a full surface water drainage scheme, including details of the size, position and construction of drainage works, shall be submitted to, and approved in writing by, the Local Planning Authority. The drainage scheme shall be designed to accommodate a 1 in 100 year storm + 40% CC and shall be implemented in accordance with the approved details prior to the occupation of the development hereby approved. Reason: To ensure the proper provision of surface water drainage and to ensure flooding is not exacerbated in the locality in accordance with Policies INF4 and EP4 of the South Oxfordshire Local Plan 2035.

Prior to the commencement of development, a full foul water drainage scheme shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall include details of the size, position and construction of the drainage scheme, all coupled with calculations to evidence this. The development shall be carried out in accordance with the approved details prior to the first occupation of the development hereby approved. Reason: To prevent pollution in accordance with Policies INF4 and EP4 of the South Oxfordshire Local Plan 2035.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order) the provision within the curtilage of the dwelling of any building, enclosure or swimming pool as described in Schedule 2, Part 1, Class E of the Order shall not be undertaken without obtaining planning permission from the Local Planning Authority. Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity in accordance with Policies STRAT1, DES1 and DES2 of the South Oxfordshire Local Plan 2035.

Sustainable design features shall be incorporated into the construction and fittings of the dwellings hereby approved, details of which shall include an Energy Statement and shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development. The sustainable design features shall thereafter be retained. Reason: To ensure high standards of sustainable design and construction in accordance with Policies DES7, DES8 and DES10 of the South Oxfordshire Local Plan 2035.

Prior to the commencement of the development hereby approved details of refuse and recycling storage shall be submitted to and approved in writing by the Local Planning Authority. The refuse and recycling storage shall be implemented in accordance with the approved details prior to the occupation of the development hereby approved and retained thereafter. Reason: To ensure adequate provision for the management of waste in accordance with Policy INF1 of the South Oxfordshire Local Plan 2035.

Prior to the commencement of any site works or operations relating to the development hereby permitted, an arboricultural method statement to ensure the satisfactory protection of retained trees during the construction period shall be submitted to and approved in writing by the Local Planning Authority. Written approval must be obtained prior to commencement of any site works including demolition. The matters to be encompassed within the arboricultural method statement shall include the following:- (i) A specification for the pruning of, or tree surgery to, trees to be retained in order to prevent accidental damage by construction activities; (ii) The specification of the location, materials and means of construction of temporary protective fencing and/or ground protection in the vicinity of trees to be retained, in accordance with the recommendations of BS 5837 'Trees in relation to design, demolition and construction' and details of the timing and duration of its erection; (iii) The definition of areas for the storage or stockpiling of materials, temporary on-site parking, site offices and huts, mixing of cement or concrete, and fuel storage; (iv) The means of demolition of any existing site structures, and of the re-instatement of the area currently occupied thereby; (v) The specification of the routing and means of installation of drainage or any underground services in the vicinity of retained trees; (vi) The details and method of construction of any other structures such as boundary walls in the vicinity of retained trees and how these relate to existing ground levels; (vii) The details of the materials and method of construction of any roadway, parking, pathway or other surfacing within the RPA, which is to be of a 'no dig' construction method in accordance with the principles of Arboricultural Practice Note 12 "Through the Trees to Development", and in accordance with current industry best practice; and as appropriate for the type of roadway required in relation to its usage. (viii) Provision for the supervision of ANY works within the root protection areas of trees to be retained, and for the monitoring of continuing compliance with the protective measures specified, by an appropriately qualified arboricultural consultant, to be appointed at the developer's expense and notified to the Local Planning Authority, prior to the commencement of development; and provision for the regular reporting of continued compliance or any departure there from to the Local Planning Authority. Thereafter the development shall be carried out in accordance with the approved details with the agreed measures being kept in place during the entire course of development. Reason: To ensure the satisfactory protection of retained trees which are visually important in accordance with Policy ENV1 of the South Oxfordshire Local Plan 2035.

Prior to the commencement of the development hereby permitted a scheme for the landscaping of the site, including the planting of live trees and shrubs, the treatment of the access road and hard standings, and the provision of boundary treatment shall be submitted to and approved in writing by the Local Planning Authority. These details shall include schedules of new trees and shrubs to be planted (noting species, plant sizes and numbers/densities), the identification of the existing trees and shrubs on the site to be retained (noting species, location and spread), any earth moving operations and finished levels/contours, and an implementation programme. The scheme shall be implemented prior to the first occupation or use of development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority. Reason: To ensure suitable planting is secured to help to assimilate the development into its surroundings in accordance with Policy ENV1 of the South Oxfordshire Local Plan 2035.

The development hereby permitted shall be implemented in accordance with the recommendations set out in the Preliminary Ecological Appraisal prepared by Harris Lamb Property Consultancy ref PE0148 dated July 2020 submitted with the application in all respects. Any variation shall be agreed in writing by the Local Planning Authority before such change is made. Reason: To protect the important species on the site, in accordance with provisions of the NPPF and policies ENV1, ENV2 and ENV3 of the South Oxfordshire Local Plan 2035.

Prior to the commencement of the development hereby permitted, the further bat surveys recommended in the Preliminary Ecological Appraisal prepared by Harris Lamb Property Consultancy ref PE0148 dated July 2020 submitted with the application shall be carried out by a suitably qualified Ecologist to determine the bat roost potential of trees to be removed and Tree Tops. The findings of the survey, along with one of the following, shall be submitted to and approved in writing by the local planning authority: 1. Evidence of the successful receipt of a European protected species licence; or 2. Evidence of the successful registration of the site under the bat low impact class licence; or 3. A letter from a suitably qualified ecologist explaining why a European protected species licence is not required. Reason: To protect the important species on site, in accordance with Policies ENV1, ENV2 and ENV3 of the South Oxfordshire Local Plan 2035 and paragraph 170 of the NPPF.

A proportionate and specific biodiversity mitigation and enhancement strategy, as informed by a suitably qualified ecologist, shall be submitted to the Local Planning Authority in support of and at the same time that any reserved matters application pertaining to this outline permission is submitted. Thereafter, the development shall be implemented in accordance with the approved biodiversity mitigation and enhancement strategy. All biodiversity enhancement features shall be provided on site prior to first occupation. Reason: To ensure that there is no net loss of biodiversity, in accordance with provisions of the NPPF, Policies ENV1, ENV2 and ENV3 of the South Oxfordshire Local Plan 2035 and Policy EN1 of the Joint Henley and Harpsden Neighbourhood Plan.
