Variation of condition 6 - laying out and construction of an
access, driveway or other hard standing on application ref P17/S1779/FUL.
Proposed removal of existing timber building and separate store and erection of a replacement purpose-built art studio and store for private use.
Conditions / Refusal Reasons
Prior to the first use of the building approved under application P17/S1779/FUL and this planning permission any material used to form areas of hardstanding including an access or driveway shall be removed from the application site and the land within the application site, including the highway verge, shall be restored to grass at the same ground level as existed prior to the implementation of planning permission P17/S1779/FUL.
Reason: In the interests of the visual appearance of the development in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2 and D1 of the South Oxfordshire Local Plan 2011.
That the development hereby approved shall be carried out in accordance with the plans approved under planning permission P17/S1779/FUL, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The development shall be constructed in accordance with the materials approved under application P18/S0207/DIS unless alternative materials are first agreed in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2 and D1 of the South Oxfordshire Local Plan 2011.
The landscaping scheme approved under application P18/S0207/DIS shall be implemented prior to the first occupation or use of the development as approved and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011.
External lighting will only be permitted in accordance with a lighting scheme to be first approved in writing by the Local Planning Authority.
Reason: To safeguard the rural character of the countryside in accordance with Policy CSEN1 of the South Oxfordshire Core Strategy 2027 and Policy EP3 of the South Oxfordshire Local Plan 2011.
With the exception of the temporary access associated with the application hereby permitted, which shall be removed in accordance with the requirements of Condition 1, no development comprising of the formation, laying out and construction of an access, driveway or other hardstanding within the application site shall be undertaken without the prior written permission of the Local Planning Authority notwithstanding the provisions of the Town and Country (General Permitted Development Order) 2015 (or any Order revoking or re-enacting that Order).
Reason: The specific circumstances of this site warrant the Local Planning Authority having control over any further development as specified in the condition in the interests of amenity and in accordance with Policies CSEN1 of the South Oxfordshire Core Strategy and G2, D1, G3, G4 and E8 of the South Oxfordshire Local Plan 2011.
The buildings associated with the use hereby approved shall not be used in connection with any overnight accommodation.
Reason: Having regard to the location of the site and visual amenity of the surrounding area in accordance with Policies CSEN1 of the South Oxfordshire Core Strategy and G2, D1, G3, G4 and E8 of the South Oxfordshire Local Plan 2011.
The use of the development hereby approved shall be limited to that of a private artist's studio only and associated storage within the building as shown on the approved plans. There shall be no commercial use of the land or building whatsoever.
Reason: Having regard to the location of the site and visual amenity of the surrounding area in accordance with Policies CSEN1 of the South Oxfordshire Core Strategy and G2, D1, G3, G4 and E8 of the South Oxfordshire Local Plan 2011.
