Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, KVB 520_01, KVB 520_02, KVB 520_03, KVB 520_04, KVB 520_05, KVB 520_07, KVB 520_09, KVB 520_08, LOC-001, LOC-002, KVB 520_06 and KVB 520_10, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

The materials to be used in the external construction and finishes of the development hereby permitted shall either be as agreed under application reference P13/S3740/DIS, or samples shall be submitted to and approved in writing by the Local Planning Authority. Reason: To safeguard the character of the area in accordance with Policies G2, G6, H4 and D1 of the South Oxfordshire Local Plan 2011 and policy CSQ3 of the South Oxfordshire Core Strategy.

The levels on site of the development hereby permitted shall either be as agreed under application reference P13/S3740/DIS, or shall be submitted to and approved in writing by the Local Planning Authority. Reason: To ensure that the development properly relates to the levels of adjoining development in the interests of amenity and in accordance with Policies G2, G6, H4 and D1 of the South Oxfordshire Local Plan 2011 and policy CSQ3 of the South Oxfordshire Core Strategy.

The first floor bathroom and stairwell windows in the side elevations of the dwellings hereby permitted shall not at any time be glazed other than with obscured glass. They shall be fixed shut, with the exception of a top hung openable fanlight and be permanently so retained thereafter. Reason: To ensure that the development is not unneighbourly in accordance with Policy H4 and D4 of the South Oxfordshire Local Plan 2011.

The first floor bedroom windows in the side elevations of the dwellings hereby approved shall have a minimum cill height of 1.7 metres above the floor of the room in which the windows are installed and shall be permanently so retained thereafter. Reason: To ensure that the development is not unneighbourly in accordance with Policies H4 and D4 of the South Oxfordshire Local Plan 2011.

The ground floor lounge windows in the side elevations of the dwellings hereby approved and facing towards 10 and 14 Manor Road, shall have a minimum cill height of 1.7 metres above the floor of the room in which the windows are installed and shall be permanently so retained thereafter. Reason: To ensure that the development is not unneighbourly in accordance with Policies H4 and D4 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any Order revoking or re-enacting that Order) other than those windows shown on the approved drawings, no windows, doors or other openings shall be inserted at any time in the side elevations of the dwellings hereby approved facing towards 10 and 14 Manor Road. Reason: To safeguard the amenities of the occupiers of adjoining properties in accordance with Policies H4 and D4 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any Order revoking or re-enacting that Order), the enlargement of any dwellinghouse as described in Schedule 2, Part 1, Class A of the Order shall not be undertaken without the prior written permission of the Local Planning Authority. Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity and in accordance with Policies G2 and D1 of the South Oxfordshire Local Plan 2011 and policy CSQ3 of the South Oxfordshire Core Strategy.

The measures set out in the sustainability statement which accompanied the application, in respect of sustainable building, shall be implemented in accordance with the statement prior to the first occupation of any unit, unless as may otherwise be agreed in writing by the Local Planning Authority. Reason: To ensure sustainable development in accordance with Policy CSQ2 of the South Oxfordshire Core Strategy.

Prior to the first occupation of the development, the parking and turning areas shall be provided in accordance with the approved plan KVB520_03 and shall be constructed, laid out, surfaced, drained and completed, and shall be retained unobstructed except for the parking of vehicles at all times. Reason: In the interests of highway safety and in accordance with Policies H4, T1 and T2 and Appendix 5 (Car Parking Standards) of the South Oxfordshire Local Plan 2011.
