Conditions / Refusal Reasons
The development shall begin before within two years from the date of this approval for reserved matters. Reason: To comply with conditions in the outline planning permission P02/W0848/O and by virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004. The development hereby approved shall be carried out in accordance with the details shown on the submitted plans listed in the letter from RPS dated 4 November 2010 except as controlled or modified by conditions of this permission. For the avoidance of doubt, where there may be discrepancies between (i) the development visuals and character areas and details with (ii) the layout drawings and housetypes, the latter shall take precedence. Reason: To secure the proper planning of the area in accordance with the Development Plan Policies. Related application(s): P10/W1966/DIS

Prior to the commencement of development details and samples of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority. Reason: To safeguard the character of the area in accordance with Policy D1 of the South Oxfordshire Local Plan 2011. Related application(s): P10/W1966/DIS

That a scheme for the landscape planting of the site including live trees and shrubs, pit design for tree planting within streets or hard landscaping and the boundary treatment details for Plots 85 and 94, shall be submitted to and approved in writing by the Local Planning Authority prior to commencement of this phase of development. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policies C9 and D1 of the South Oxfordshire Local Plan 2011. Related application(s): P10/W1966/DIS

Prior to commencement of this phase of development revised details of the footway and cycleway shown on Drawing 102-53-02 P2 'General Earthworks Pond 3' shall be submitted for approval in writing by the Local Planning Authority and implemented in accordance with the approved details. Reason: To ensure that the design details of footway / cycleway are in accordance with Policies T1 and D1 of the South Oxfordshire Local Plan 2011. Related application(s): P10/W1966/DIS

Notwithstanding the details submitted with this application an arboricultural method statement and tree protection measures for this phase shall be submitted in accordance with Condition 26 of the Planning Permission P02/W0848/O prior to commencement of this phase of development. The statement shall include root protection areas and their detailed calculations. In the event that the construction of development on Plots 209 -220 (inclusive) and the temporary footpath north of Stephen Freeman school encroaches into the root protection areas, revised details of the construction shall be submitted for approval in writing by the Local Planning Authority and the development shall be constructed in accordance with the approved details. Reason: To safeguard trees which are visually important in accordance with Policies C9 and D1 of the South Oxfordshire Local Plan 2011. Related application(s): P10/W1966/DIS

Prior to commencement of this phase of development details of the location and specification of street furniture, including cycle racks and stands, bus shelters, seats, signs, bollards, lighting columns and other external structures, shall be submitted for approval in writing by the Local Planning Authority. The street furniture shall be implemented in accordance with the approved details. Reason: In the interests of visual amenity in accordance with Policy D1 of the South Oxfordshire Local Plan 2011.

Details of lighting for roads and other external areas shall be implemented in accordance with details that shall have first been submitted for approval in writing by the Local Planning Authority. Reason: In the interests of visual amenity and highway safety and to minimise light pollution in accordance with Policies D1, T1 and EP3 of the South Oxfordshire Local Plan 2010.

Prior to the commencement of this phase of development details of tenure mix on the affordable housing units as shown on Drawing 69-1681-NN1-103 Rev H shall be submitted and approved in writing by the Local Planning Authority. The tenure for those units must be in accordance with the approved details unless otherwise agreed in writing by the Local Planning Authority. Reason: To meet the housing needs of the Council in accordance with Policy H9 of the South Oxfordshire Local Plan 2011.

Prior to the final occupation of this phase of development a schedule identifying plots numbers with postal addresses shall be submitted to the Local Planning Authority. Reason: To enable monitoring of conditions on this development.

Prior to the first occupation of flats (plots 176-184) the public urban space to the south of this development shall have been provided and ready for use. The public urban space shall be implemented in accordance with details which shall have first been submitted to and approved in writing by the Local Planning Authority. Reason: To ensure that the residents of the block of flats (plots 176-184) have access to adequate amenity space in accordance with Policy D3 of the South Oxfordshire Local Plan 2011.

The garage accommodation on plot numbers: 20, 21, 22, 23, 53, 54, 55, 78, 86, 185, 186,187, 194, 195, 196, 197, 198, 209, 210, 211, 212, 213, 214, 215, 216, 217,218, 219, 220 shall be retained as such and shall not be adapted for living purposes without the prior written permission of the Local Planning Authority. Reason: In the interests of design and highway safety and to ensure the provision of adequate off-street car parking in accordance with Policies D1, T1 and T2 and Appendix 5 (Car Parking Standards) of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development Order) 1995 (or any Order revoking or re-enacting that Order) the erection or construction of gates, fences, walls or other means of enclosure as described in Schedule 2, Part 2, Class A of the Order shall not be undertaken on Plots: 109-113 inclusive, 127-133 inclusive, 143-146 inclusive 154-159 inclusive,185-202 inclusive, 209-220 inclusive without the prior written permission of the Local Planning Authority. Reason: To ensure the Local Planning Authority retains control over any future development in the interests of design and amenity and in accordance with Policies G2 and D1 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of The Town and Country Planning (General Permitted Development) (Amendment) (No. 2) (England) Order 2008 (or any Order revoking or re-enacting that Order) the provision within the curtilage of the dwelling of any building, enclosure or swimming pool as described in Schedule 2, Part 1, in Class E of the Order shall not be undertaken on Plots 13, 25, 49, 108, 127, 146, 172, 190, 191 and 209 to 220 inclusive without the prior written permission of the Local Planning Authority. Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of neighbour amenity and design in accordance with Policies G2, C9, D1 and D4 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any Order revoking or re-enacting that Order), the enlargement, improvement or other alteration of any dwellinghouse as described in Schedule 2, Part 1, Class A of the Order shall not be undertaken on Plots 13, 25, 49, 108, 127, 146, 172, 190, 191 without the prior written permission of the Local Planning Authority. Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity and in accordance with Policies G2 and D1 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country (General Permitted Development Order) 1995 (or any Order revoking or re-enacting that Order), no development as specified in Schedule 2, Part 1, Class F shall be undertaken within the tree root protection area of Plots 209-220 inclusive without the prior written permission of the Local Planning Authority. Reason: The specific circumstances of this site warrant the Local Planning Authority having control over any further development as specified in the condition in the interests of amenity and in accordance with Policy C9 of the South Oxfordshire Local Plan 2011.
