Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, BLO-001, LOC-001, PE-001 and PF-001, and Air Conditioning Details CU-TZ50WKEW except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
No development shall take place until a detailed prediction of the noise produced has been submitted to and approved, in writing, by the Local Planning Authority. The report must be prepared in accordance with BS4142 (2014) Method for rating industrial and commercial sound'. The report should include:
o A large scale plan of the proposed development
o Noise sources and measurement/ prediction points marked on plan
o Noise levels produced by noise sources (e.g. air conditioning units, refrigeration plant etc. at the nearest noise
sensitive location
o The rating level of the noise - is it tonal or intermittent?
o The times of operation of the equipment
o The background noise level at the nearest noise sensitive location
o Details of noise mitigation measures proposed
o Description of noise calculation procedure
o Comparison of noise levels with appropriate criteria
Where necessary, following approval of the noise assessment the applicant must submit a detailed scheme to control the noise which must be approved in writing by the Local Planning Authority. The approved scheme must then be implemented and maintained for the duration of the development.
Reason: To ensure that the development is not unneighbourly in accordance with Policies ENV12 of the South Oxfordshire Local Plan 2035.
No development shall take place until a detailed scheme for protecting the dwellings from the external noise environment of the area, as recommended in the noise impact assessment report undertaken as part of the above condition, has been submitted to and approved in writing by the Local Planning Authority
The scheme itself shall be designed, specified and constructed so that the sound insulation performance of the structure and the layout of the dwellings is such that the indoor ambient noise levels do not exceed the values detailed in Table 4 of BS 8233:2014 "Indoor ambient noise levels for dwellings". Thereafter the development shall not be carried out other than in accordance with such approved scheme which shall be completed before any part of the accommodation hereby approved is occupied, unless the Local Planning Authority otherwise agrees in writing.
Reason: To safeguard the amenities of the occupiers of the proposed development in accordance with Policy ENV12 of the South Oxfordshire Local Plan 2035.
