Construction of 3 x 2-bedroom, 1 x 3-bedroom and 2 x 4-bedroom dwellings incorporating parking and turning areas.(as amended by drawings accompanying agent's emails dated 19th February and 4th April 2014)
Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 1171/1, 2996/200, 2996/206 C, 2996/201 C, 2996/202 D, 2996/203 D, 2996/204 D and 2996/205 D, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The ground and finished floor levels of the development shall be in accordance with the details shown on drawing 2996/202 D, unless otherwise agreed in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy and Policies D1, G2 and H4 of the South Oxfordshire Local Plan 2011.
The exterior of the development hereby permitted shall only be constructed in the materials specified within the agent's email dated 13th May 2014 or in materials which shall previously have been approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, D1 and H4 of the South Oxfordshire Local Plan 2011.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any Order revoking or re-enacting that Order with or without modification), no enlargement, improvement or other alteration of the dwellings permitted by Class A of Part 1 of Schedule 2 of the Order shall be made without the prior written approval of the local planning authority.
Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity and in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, D1, and H4 of the South Oxfordshire Local Plan 2011.
The development hereby approved shall be carried out in accordance with the details contained within the Construction Method Statement dated 14th January 2014.
Reason: In the interests of highway safety and to mitigate the impact of construction vehicles on the surrounding highway network, road infrastructure and local residents, particularly at morning and afternoon peak traffic times and in accordance with Policy T1 of the South Oxfordshire Local Plan 2011
The dwellings hereby permitted shall not be occupied until the parking and turning facilities have been completed in accordance with the details shown on drawing number 2996/202 D. Thereafter, the approved parking and turning facilities shall be used for no other purpose.
Reason: In the interests of highway safety and in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.
The hard and soft landscaping of the site as shown on drawing 2996/201 C shall be implemented in full prior to the first occupation of the development hereby approved. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9, D1 and H4 of the South Oxfordshire Local Plan 2011.
No building work shall be undertaken, nor any equipment, machinery or materials brought onto the site for the purposes of the development hereby permitted until a scheme for the protection of trees to comply with BS5837:2012 has been implemented in accordance with the details shown on drawing 2996/201 C. The approved scheme of tree protection shall remain in place until the development is complete.
Reason: To safeguard trees which are visually important in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9, D1 and H4 of the South Oxfordshire Local Plan 2011.
The first floor bathroom windows in the rear (south east) elevations of Plots 3 and 4 hereby permitted shall be glazed in obscure glass, and shall be fixed shut with the exception of a top hung openable fanlight, prior to the first occupation of the accommodation and it shall be retained as such thereafter. The cill height of the first floor bedroom rooflights in the rear (south east) elevations of Plots 3 and 4 hereby permitted shall be set at least 1.7 metres above internal floor level of the rooms they serve. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any Order revoking or re-enacting that Order with or without modification), no further openings shall be inserted at first floor level in the rear (south east) elevations of Plots 3 and 4.
Reason: To ensure that the development is not unneighbourly in accordance with Policies D4 and H4 of the South Oxfordshire Local Plan 2011.
